Hi, my fiance has been denied the B2 Visa twice, in November and as recent as this month, we plan to switch to apply for K1 ASAP, do you think it would improve our chances to hire an attorney because of the B2 denials?

A small complication: The company which did her first B2 application (yes it was a mistake to hire some small company to fill out the apps than doing it by herself) mistakened marked the (ever been denied visa by other countries?) question as no (she had been denied visa to France once, but got it on 2nd attempt and lived there for 6 years), but was corrected on the second B2 attempt, but nonetheless did not get approved.

I spoke with some attorneys, they said I generally have a good case, but the B2 denials could affect our K1 application and suggested hiring an attorney. What do you think, is it worth the money and does it improve our success rate?

I just saw in another post a few rows up (later time) from this one where the post owner was denied the K1, and for reasons most likely being denials on his previous B2. So it makes me wonder, I know my girlfriend since March, but she was denied the B2 in Novmeber and December, and she did not mention anything about me on her B2 app (because she was still just thinking about traveling & seeing and not necessarily settling down here at that time), will that become an issue for her K1 interview?? That is why I am thinking if hiring an attorney would help in this case?

Previous visitor visa denials are not a problem for the K-1. You do not need an attorney.

Maybe so and maybe no. Depends on the country/Embassy. Depends on the reasons for the previous denials.

She is a citizen of China and the reasons given to her for both B2 denials were Not enough documentation/proof to prove her ties in China would prevent her from staying in the US for good, even though she does own property in China. She doesn't currently have a job however.

your k1 may/may not be approved, as baron said, it depends on the country/embassy. no, a lawyer will not help. all a lawyer is good for is to help you prepare the petition. beyond that, he/she cannot influence whatever decision is made. I have seen plenty of people get approved even after several b2 denials though. just prepare your petition real well
