PachucoBro, I appreciate you bringing some things to light. Im in Dallas & totally understand. Many ----my neighbors work to provide for their families & I know they are not even legal to be here. Im pretty sure of that. I just feel that if people want to work, Darn it let them work. Better than those who want something for free & we are paying for it. I wish you & your wife good luck. My fiancee will have a hard time sitting at home so I will encourage him to find something if it helps him. We dont need it, but will exercise our GIVEN RIGHT for 90 days, Legally. Be Blessed.

I take it you didn't read thread where PachucoBro admits he was wrong about his assertions in this thread.

You CANNOT LEGALLY WORK in the first 90 days WITHOUT AN EAD STAMP. After that, you need to stop working and wait for your EAD. We came back full circle to what others were trying to clarify here in the first place!

My understanding is that it is illegal to work without work authorization. It is illegal to get paid in cash and not report this to the IRS. People still do these things though (and can). We can all choose to break whatever rules/laws we want. It's quite clear that a person is not supposed to work without authorization to work

Save yourself the bother and print out a copy of USCIS form I-9. If you can't meet the requirements on page 3 of the I-9 you can't legally work. If an employer allows you to work even though you can't meet the I-9 requirements, they are breaking the law.

Hi,

I just arrived on a K3 and went to the Social Security Office in Austin, TX on Friday. I was told previously that you needed EAD to get a SSN but like with everything related to US Visa process there's a lot of miss-information so thought I'd wing it. Beats sitting on the couch anyway ;)

After an hours wait I was told categorically the two following facts as stated by the agent and her supervisor who was the manager of the Administration office.

1) They only offer one type of SS Card to K3 Visa holders and that is the one that has "VALID FOR WORK ONLY WITH DHS AUTHORIZATION" written on it.

2) They need to use information on the EAD to enter into the system to produce this SS Card and number so it's impossible for them to issue a SSN without seeing the EAD.

Just one question !

How has anyone on a K1/K3 gotten a SSN before getting EAD ?

Sorry I lied, question two..

Why on earth would ANYONE contemplate working without authorisation after going though the visa process when you are risking deportation and 10 year exclusion ??? I just don't get it !

Lots of people get the SSN before they send any documents for AOS and EAD

Why on earth would ANYONE contemplate working without authorisation after going though the visa process when you are risking deportation and 10 year exclusion ???

1) they have no respect for the law, I assume 2) working without authorization is forgiven via marriage to a USC - there is no deportation or 10 year ban for illegal work if you are the spouse of a USC . . . maybe that's why?

Yeah, my husband came here on a K-1 on August 11th, applied for his SSN and we got it a couple days before we were married on Sept 8th

Yes it is very easy to get a SS card. The rule of thumb is to wait atleast 2 weeks or so after arriving so that all the cimputer systems are updated with your entry information. Otherwise when you hit the SSA office they will not see all the info they need to see to issue you a card.

Also when you give SSA you mailing address make sure you put a 'c/o' with the citizen's name on it as the postman may choose not to deliver the card to your address where he/she has not seen your fiancees name before.

We goofed and it caused us to wait an additional 2 weeks to get our official card in the mail, however we did go back to the SSA office and they gave us the number which allowed her to oper her bank account and a few other things.

It seems very unfair that people with that crappy little stamp can work when others can't. How a little red smudge on my I-94 can count as something as official sounding as "DHS authorisation" is beyond me!

If I'm honest I probably would've tried to get a job without having the stamp if i hadn't gone through JFK. So far they haven't looked at the smudge... Why you have to stop after 90 days is also beyond me, and very irritating.

K3 can not get a SS card without an EAD,

K1 has the right to work with the correct DHS Autorization.

I have no clue why they arent the same when it comes to getting a SS card. The SS office has a list of visa catagories that it must check when putting your info into the system. If its K3 they will tell you to come back with an EAD or Green Card, if its K1 then your all set, (with the printing on the card 'Valid with DHS Authorization'.

Yes, if

- you have applied for an EAD because, having applied, you have 90 days before the employer needs to see the EAD, or

- as in your wife's case, if the employer violates the law by not asking you to show them your EAD.

..... My information that I originally wanted new comers to this part of the process to know is "YOU CAN WORK during the frist 90 days after you get a SS card, WITHOUT having to have a EAD to show."

Because the words 'employment authorized' mean exactly what they say, whether they're written in red ink on an I-94 or in black ink on a high-tech plastice card.
