Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you for your inquiry of December 20.

Section 221(g) of the Immigration and Nationality Act (INA) prohibits a consular officer from issuing a visa to an alien if the officer has reason to believe that the alien is ineligible. Based on indications that petition KEV2013XXXXXX contains inaccurate information, we have returned it to the Bureau of Citizenship and Immigration Services (USCIS) of the Department of Homeland Security (DHS) for review and possible revocation. If USCIS determines that the information we have provided would establish a sufficient foundation for initiating revocation proceedings, it will send the petitioner a notice of intent to revoke that includes a statement of the facts and evidence, and provide the petitioner with an opportunity to respond. Under INA 222(f), which addresses the confidentiality of visa records, we are unable to provide any further details. Further inquiries about this case should be directed to USCIS.

I had an attorney prepare our petition. We added travel document, air tickets, passport, boarding pass, etc, and engagement pics, rings receipts, hotel receipts, telephone, skype records, etc.

She is 3 years younger than me and we both are of same religion and cast. I have been divorced 10 years ago. I have two kids. The red flag on my side is that 11 years ago I have a misdemeanor, DV, which is expunged, on a minor charge. I fully disclosed it on my petition. I attached copies of court records. I told my fiancee about this before I we got engaged. The CO asked her about it and she did say that she is aware of it. I tought because my petition was approved by USCIS, it should not effect the interview because it is not new information at the time.

Only other red flag is that my fiancee attended a visitor visa but denied only few months before we met. Other than that I don't know what could be the reason. Would my DV conviction cause problem with I-130 also if infact it was an issue this time?

I don't see anything that would cause this denial other than its India. India is similar to my country in its history of fraud by the people trying to gain entry into the USA. Something happened that caused the officer to think something was out of place.

I doubt this was about a situation the happened 11 years ago nor the B 2 denial.

What did the lawyer think happened?

Are you sure it wasn't due to the DV, even though it was expunged? I believe they can still hold this against you as this is one of the few charges that they actually worry about.

-Mar 12, 2014 Arrived at Embassy

-Mar 20, 2014 Packet 3 sent to Embassy

-Mar 28, 2014 Received packet 3 instructions in mail

-Mar 25, 2014 Interview date set

-Apr 4, 2014 Interview.. approved :dancing:

-May 21, 2014 - PoE LV NV

I think a minor 11 years-old expunged misdemeanor is a wrong reason to deny visa because I disclosed it in my petition , it was reviewed by USCIS and NVC, and my fiancee is aware of it. Unfortunately no reason was specified and there no appeal.

the only thing i can say is that divorce is not the reason of denial.

i petitioned right in a month after my divorced, i got approved and now i am in the US with my fiance

FRom India ummm no why would you think its so easy. From countries where we have to apply for Visa to visit is more than 50/50 denial. And some 0ver 90% denial. There's no such thing to a Non-VWP as an easy Visa. It's easier to immigrate than it is to visit for most of us.

And B2 denials always the same "no strong ties to country". Is the usdual denial.

You are applying what you know from England to India where B 2 s are very hard to get.

Timeline

India is one of the countries where getting a visa is nearly impossible. The K1 is hard (I had a friend have his declined as well even though they had more than enough evidence) and even visitor visas are hard to come by from there.

I am sorry to hear, but I would suggest what others said already.
