K1 Fiance Visa Question About Expiration

My husband entered the US in September with his K1 Visa and he just had his EAD appointment today for his bio-metrics. We noticed his K1 expires in a month, does anyone know what we do if he doesn't receive his EAD before the K1 expires?

K1 Visa is one time use for entering US. Thus it does not matter if it expires in a month, since it has already been used.

He is still in legal status while waiting for AOS adjudication.

Done with K1, AOS and ROC

The K-1 visa expired the moment he arrived in the US. If you already have a pending adjustment of status case, then you are fine. You still have legal status while waiting your approval even after the expiration on your I-94. If you want proof of your status, keep a copy of your NOA1 receipt of your application with you.

ROC

NOA1:  05/24/2017;  Biometrics:  06/13/2017;  Approved without interview:  09/05/2018;  10 Yr Green card Received:  09/13/2018

 

Naturalization

08/09/2020 -- Filed N-400 online

08/09/2020 -- NOA1 date

08/11/2020 -- NOA1 received in the mail

12/30/2020 -- Received notice online that an interview was scheduled

02/11/2021 -- Interview

As noted by others the K-1 visa expired the second POE was cleared, the I-94 is now the controlling document for status. You have filed for AOS so relax all is fine. :)
