Applying for I-130 for spouse -need some advice

Hello everyone,

My husband and I have been together for 6 years I meet him while working in the USA as a nanny, Then he came over to Australia and has lived here with me for the past 4 1/2 years and is an Australian permanent resident. We have decided to move back to the states to be with his family. We got married about a month ago and he has gone back to the states for a job and to apply for my I-130.

He is stressing out as he really wants to make sure he does all the paperwork right so it doesn't get sent back.

I want to check that all we need for the first lot of paper work is the I-130 forms, the G-325a forms (one for me and one for my hubby), hubbys proof of US citizenship, marriage certificate, our passport style pics and all our evidence of our relationship. Oh and of course the check lol they wouldn't do ####### all with out the money lol

Is that all ?? I just want to make sure before he posts it away.

Another question i wanted to ask was, Does anyone know if there would be a problem if my husband came back to Australia and worked here while we wait for the visa ?? Our only concern is the financial stuff towards the end of the visa ( showing his work, income, tax ect) as it will all be Australian evidence not american??

We didnt realize the visa would take so long and being newlyweds we dont want to spend so much time apart. So he would apply for the visa and about a month or so after that he wants to come back to Aus and wait for the process together.

Any help or advice anyone has would be great!

Do you have co-sponsor for the I-864? That would be the one way to qualify if he is going to work in Australia during the process. Or if you have assets. Thats also an option.

But your list of things to submit is right on target. And you already have the best evdeice and #1 which is living together. Nothing beats facetime. Everything else is secondary. Good for you.

If you have a Joint sponsor,your huby returning to meet you in Austalia wouldnt pose any problem. I would advice that you do your paper work at

the US embassy in Australia (Direct Consular Filing). DCF takes a short time to process your immigration unlike filing in the US.

I have only recently learnt about DCF but not sure I can do it from Australia i need to do more research into it.

It can be anyone you do not have to be a family member. Long as they are a US citizen or LPR (Legal Permanent Resident).

Unfortunately there is no DCF available in Australia.

It can be anyone you do not have to be a family member. Long as they are a US citizen or LPR (Legal Permanent Resident).

Unfortunately there is no DCF available in Australia.

yeah after doing my research i found that they stopped doing DCF in Australia in Augs 2011 which sucks but nothing to worry about just do it from over there
