Visa Bulletin Predictions and Comments by Charles Oppenheim (April 2014)

April 29th, 2014

Visa Bulletin Predictions – Family-Based

Additionally, Mr. Oppenheim was able to provide some predictions and expectations for movement of visa numbers over the next few months for the family-based categories as well.

FB-2A. Demand is starting to increase; as a result, FB-2A Mexico will retrogress soon. FB-2A ROW is also likely to retrogress, perhaps back to 2012 in the June or July 2014 Visa Bulletin.

FB-2B. Due to low demand currently, additional forward movement is expected.

Note on Timing of NVC Fee Invoices

Mr. Oppenheim noted that the National Visa Center (NVC) is sending our requests for fee payments about 8 to 12 months in advance of the priority date becoming current (this is change to the previous practice of doing so 12-18 months in advance). When applicants pay the fee earlier after receipt of the fee invoice, Mr. Oppenheim is able to “see” the demand earlier and adjust the demand in the category accordingly, eliminating the need of major forward movement, followed by a retrogression.

So we r going back in 2012 soon....guysss.......Just chill out and wait for 1 more year for ur Spouses and Children.....

Hello everyone,

I am new to the room and a November filer.I am just a little bit confused about the visa bulletin news and can someone in the room elaborate how it affects for people who filed their petition on November 22 2014. Additionally I am still waiting for NOA2 from VSC which,I haven't got yet however, when I checked the processing time at VSC it shows that for F2A catagories from 5 month it is now moved to 6.2 month. Thank you in advance for your time replying to my questions.

Charles Oppenheim, Chief of the Immigrant Visa Control Unit at the U.S. Department of State (DOS), recently provided expectations for cutoff date movement for the remainder of fiscal year 2014 (FY14). There is no one better positioned than Mr. Oppenheim, as the chief of the office responsible for issuing the monthly visa bulletin, to make these predictions based on usage of immigrant visa numbers and trends in the different categories and chargeability areas. However, it is important to understand that these are only predictions, not guarantees.

Dear Habel,

This is a good question and many find it confusing. The visa bulletin is like a ticket at a deli counter. you got a place in line when you received the approval receipt. You are waiting for your number to be up. You are allowed to file adjustment petition when your priority date is before the visa bulletin date. There is an annual limit to the number of people who can obtain permanent residency as the recognized spouse or child of a green card holder (otherwise known as the F2A category) each year.

USCIS processing times indicate how long (approximately) it will take to process the petition (I-130). The visa bulletin indicates when your priority date will become current (when a visa number/green card number will become available) for you.

Dear DanDaniel,

Many thanks for your assistance and it is now a more clearer than earlier. Just to clarify your answer at the moment the USCIS visa bulletin indicates that they are giving out visas to people who filled their I-130 petition before September 8 2013 therefore, for people like me who filed their petition on 22/11/2013 had to wait until the current visa bulletin shows November 30 2013. If that is the case then according to several sources in the internet they are predicting that the wait will be retrogressing when they post the June or July bulletin. How sad can this get? :crying: Well we do not have any other options to be reunited with our loved ones rather than wait and pray.

@dew drop - that's good to know. i wouldn't be surprised if they are processing the NOA2 but not releasing them...just the ones that have RFE. it just doesn't seem fair to approve i-130 so close their PD....thus leaving applicants with less time to respond.
