My fiance is scrambling to get this document. She finally got it but cannot have it notorized even though she has my power of attorney. In U.S there's no such thing, as far as research online goes. They said the paperwork is implemented in May 2013 and a lot of people are missing this. She also met a couple and he had to book an earlier flight to complete this over in VN in person. Does anyone know where I could obtain this letter? I can try to complete it and send it over or will I need to book a new flight for this? Please let me know. Thanks.

What is the name of this document? I haven't heard of such a thing.... Is it for the petitioner or beneficiary? I did not see this in list of items for package 4...

APRIL 2, 2014: PASSED VISA INTERVIEW! :)

July 30, 2014: Entered United States on K1 Visa

August 15, 2014: MARRIED

October 16: NOA 1 for I485 and I765
November 6: Biometrics
December 30: EAD approved and mailed

You are getting married in Vietnam or in the United States? I ask because we are applying for the fiance visa to get married in the states; maybe this only applies to those doing the spousal visa???i

Lot of confusion here... OP, please enlighten us:

1. Who delivers this "statement in-lieu of certificate of non-impediment to marriage" document? The VN Embassy in the US, the US Consulate/Embassy in VN, or some other entity?

2. Or is it a document that you write yourself, and get notarized? If so, does the beneficiary write it, or does the petitioner write it?

3. After it's done, who and where is it submitted to?

The Country of Vietnam requires this paperwork for foreigners to be married to a Vietnamese citizen and it has to be done by a U.S citizen. As far as I know, since the paperwork is new, I cannot find any info about this online for the U.S citizen but other countries...ie Canada has this. In Canada, they said the embassy has to stamp them. So for the U.S you can have the U.S Embassy in Vietnam stamp it for you. But in the U.S there's no such thing...unless it's new and not a lot of people know about it. AFter it's done, you submit it with your marriage packet like usual

You might want to have it notorized in the US. I got married here in VN and did the old form before the change. However, it had to be notorized also and the only place to do it was the US consulate who charges $50usd per document.

You will need to read up on apostile. Fancy term for having things certified and paying a fee.

So...you get the Secretary of State of the state in which you are located certify the notary's stamp. If you are lucky the Việt Nam government will accept this level of certification. If not you need the DoS to certify the state seal.

Or..you can do what I did and pay someone in Little Siagon here in OC to magically handle everything. For that matter there are folks in Siagon (big) who will similarly handle...for a fee.

I have the single status affidavit, signed by Hilary Rodham Clinton, the Secretary of State at the time. When I got to VN to get married I discovered that is simply not enough. I was told to bring my marriage record since I was 18 years old. The single status means nothing because you are basically swearing that you are free and available to marry.

I still got married, had the wedding, but we could not register. I am applying for a fiance visa. My wife (or fiance) has to get a single status letter in VN also for her interview. It goes both ways. But the single status letter alone will not be enough to get married in VN. Maybe I was unlucky, got an official who just wanted to give me a hard time even though my lawyer said the single status letter is all you need.


the single status has to be notorized, certified by the Secretary of State in the state you live, and certified by the Secretary of State of the United States. You can hire a lawyer or a company to do this for you. I paid $800.

Ya it is best to do it in VN. I prepared in the US and paid 600 for the fees and paperwork fees. Found out I had to do the one more in VN to complete the package. If I had done this in Vn, not only it's quick, but also costs less. But now I know that when you complete the package though the correct chain of command, you need this paperwork. A notary stamp isn't enough.

You should be fine. This is only if you were getting married in VN. It's a stupid piece if paper that has no meanings other than making money and wasting your time in VN. The fking states that you are single and even though they cannot prove that you aren't, you have to tell the truth.
