Hey all,

I finally had that time to explain everything to my wife's step dad and he is going to begin the paperwork and get everything together around Monday, but HE had a question regarding the information that he needs to provide along with the form I-846.

I am reading different things in older topics and such so I wanted to make sure this list was correct (even if there is something not required in the instructions, I'd rather send it all and not risk an RFE.)

I should also clarify he does not live in the same household and doesn't file taxes jointly, his wife and son are listed as his dependents.

I told him this:

  1. Form I-864 Affidavit of Support filled out & signed
  2. Copy of birth certificate OR passport's biometric information to show proof he's a USC
  3. Copy of driver's licence (to show proof that you do not reside in the same house as your dependents tax-wise, because that would require you fill out a different form called I-864A, correct me if I'm wrong?)
  4. Copies of 2012, 2011, and 2010 tax transcripts
  5. Copies of W2s or 1099s from 2012, 2011, and 2010
  6. A letter of employment in the following format if possible:

"To whom it may concern: (first name, last name) has been employed full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)"

The letter should be on company letterhead, according to the website.

His concerns were: He works for the government on a military base (he's ex military) but currently works in an office/computer type job now. He is the manager, and he didn't know how to go about getting a letter of employment since he's one of the most high up people in his department and it's the government. With that being said, he was unsure if the letter could be really basic and just show proof that he does indeed have a job there or if it has to be more personalized.

Also, are pay-stubs required of him as well in addition to all of the above?

Thanks in advance! He's mailing it all and I didn't want him to have to send us multiple packages because I forgot to mention something in the first go.

- Regarding 3), there's no need for him to show were he lives. The 864A is a different thing. He will only file the 864.

- Regarding 4), I assume you meant tax returns, not transcripts (because if you meant transcripts, then no W2's or things like that are necessary)

- Regarding 5), remember you also need any other thing that was part of the tax return (some people have Schedules, other forms, etc). If you are doing the transcript, then everything is already included.

- Both the pay stubs and letter of employment are optional, but good to show if you can. I had only pay stubs and no letter of employment and it worked fine. I would think pay stubs are better than a letter, so I would show that if you ask me, but we are in "optional" territory so I don't know.

Okay, I just wasn't sure if he needed to show proof as to him living in a different state even though he financially provides for his wife and son as if he lived here who I currently share a house with (my wife and I rent the in-laws suite)

Tax transcripts (i.e. the ones ordered online from the IRS website, not the actual tax returns) is what I meant, I just thought that immigration wanted the W2s etc separately as well. I've also read people just sending in this past year but I believe I read on the instructions that you can send in the past 3 years optionally.

And okay, good to know. I didn't mention the pay-stubs to him so I'll let him know to try and get both if not, one or the other to suffice.

Doesn't have to be from a boss. It can be from the HR department as well.

Right, I emailed him last night and told him his HR department I'm sure could provide a generic, typed letter indicating his job status, salary and how many years he's worked there.
