Form I-824? Why do USCIS ask us to file it?

Hi everyone! My husband received the hard copy of NOA2 this afternoon (USA time), scanned and emailed it to me. It says we have to fill up form I-824, submit it to USCIS to request them to forward our case to NVC for further processing. I researched for it, found the form, and I found my husband also had to pay for $405.

My questions are, after we fill up this form, pay, and submit it to USCIS, how many days will it take for us to wait until USCIS forward our case to NVC? and how many days will it take for NVC to notify us and tell us to do the next steps? I would appreciate any answer related to these questions. I just would like to have an estimated time in my head.

And I'm also wondering why others didn't have to file for I-824 and was already forwarded to NVC? I am confused here. Hehe :)

So we dont have to file it? But the notice we recieved said we have to? Im really really confuse.

Your husband needs to call the USCIS and make sure your case is headed to the NVC because you are not adjusting status. It should not be going to the NRC. He needs to call ASAP!

What happened in your case did USCIS send your petition to NVC yet.

Hello there! Yes USCIS already forwarded our case to NVC last January 16, 2014.

I think its because I emailed the ombudsman and the Texas Service Center for help that USCIS were able to fix it right away. I am very thankful. Now we're just waiting for NVC further instructions.

I am in same predicament now I called USCIS they put in service request and I also emailed Texas Service Center.January 6 and 13.Just waiting on outcome now.I got approved Dec 30th with same wrong wording about I 824 and that my spouse is in United States which is totally wrong..they are so called looking into getting my case to NVC pray this doesnt turn into a nightmare

That's too bad :( I don't even understand why these mistakes are done. The forms we submitted are all correct and in fact when my husband told them about it they also admitted it was their mistake. Then they asked us to wait because they will review our case. I didn't want to wait for potentially such a long time just because of a USCIS mistake so I did my best for them to hopefully notice our case and work on it. Eventually, somehow it worked. What you did by sending them an email is correct, and try calling them too to ask about your case.Talk to a supervisor.

I hope yours will be fixed soon. Just keep the Faith :)
