Hi,

I want to ask some questions in my case, we got marriaged in September 2013 and we are in process of preparing the documents. We are totally new to this forum and prepare on our own. It would be nice to get helps from anyone.

  1. I already had the SSN from school. Do I still need to fill out the I765 as a requirement?
  2. When sending the package, what kind of supporting documents should I submit? We had the joint account, authorized credit card, ultilities on each name, pictures of our wedding and all events.
  3. I did have another marriage but was divorced, but I didnt do anything about Adjustment of Status. I am wondering is this going to affect my application

Thank you,

Thank you,

1) You do not need to fill out the 765, but a) you lose nothing by doing so -it is free-, and b) it would allow you to work in whatever you want instead of the restricted work you can do with the F1 or similar. I've seen a lot of people regret not having applied for the 765, and since it is free, I would definitely do it. That being said, the most probable outcome is that you apply for it, you get the card, and then you don't use it, hehe

2) This is what I included: http://www.visajourney.com/forums/topic/425035-aos-from-student-through-marriage-check-list-cover-letter/, you can use the Advanced Search tool and check other things people have included.

3) Not at all, I think you just have to include the divorce decree (but I don't know details about this, again, you might want to use the search tool and check).

Maybe you already find it, but this is useful: http://www.visajourney.com/content/i130guide2

Thank you for your reply,

  1. Yes, I think I am going to fill out the I765 too rather than F1 OPT
  2. So, with all the supporting documents, we should send it with the application or bring it later to the interview? Up to this point, we only have 1 or 2 monthly statements of each bill, and I think we dont have enough yet. 2a) About the birth certicate translation. I do have one copy that translated in my country in 2010. Is this copy legal or do I have to have it translated in the US?

You do both: send everything that is required and everything that is suggested and you deem important, and then you will bring more stuff to the interview (things you obtained in the meantime).

You have to send a photocopy of your birth certificate (which will be in the foreign language), and also a translation of it. Anyone that knows both languages can sign the translation, but I think it has to be signed. I also think it can't be you doing the translation (I'm not sure though). What I am completely sure is a) it does not need to be done by an "official" translator, and b) I does not need to be notarized or certified, or anything like that.

The answer is YES, your wife, even if she has 0 income now, even if she never had any income, is your main sponsor.

She has to do the 864, and she has to provide her tax returns for last year (or a written explanation of why she was not required to file)

On the "current income" part, she just writes 0 and that's it.
