Hello well this is whats going on, bear with me its complicated...

I am US military stationed in Europe. Around late July 2012 I met my mexican national wife on POF.com haha. We talked up until November where she visted me in that month and stayed till January. She is a divorced single mother. She came back in March and stayed till April and in that time we got married by double proxy. She came back in May and stayed till August. I was able to get leave approved to visit her in Mexico a restricted country and visit her for 3 days in TJ. She is from Durango and we are not allowrd to go there under any circumstances unless she or my stepson were dying or her immidiete family. She and my stepson are her again with me now in December. We have a legitimate relathiomship. I provide for her and my stepson, we have a joint bank account and we stay togeyher as often as possible under European laws and when I can take leave. Im leaving in May and so am looking at doing my wife's immigration paperwork but im so confused. Obviously we cant live together for longer than 3 months because its illegal and she cant go to the United States with me.

I dont know what to do. I want to do the I-130s for them but it seems as though living together all the time is a requirement. That is impossible due to laws and now even viisiting is impossible because I cant go to Durango or Mexico easily becsuse that country is restricted to us and she cant come to me in the US. What should I do? What type of process am I looking at for my family? How can I be successful in immigrating them to the United States as fast as possible. She does not leave Europe until March and we are trying to do all the paperwork we can together and then I leave in May for the US. Help me please!

Where'd you get that you have to be living with someone all the time before filing I-130? Simply not true. File the I-130s already and get started.

Also, there's nothing speedy about immigration process. I-130 takes at least 6 months to approve so you're probably looking into September/October for interview in Mexico.

What is "married by double proxy"?

I think a double proxy marriage is when *both* partners are absent from the ceremony (so they both had reps in their place).

What is "married by double proxy"? Is that recognized by the US government?

Yes it is. Its a service offered to military members who cant marry their spouses easily. It is recognized as long as the marriage is consumated, that is proven by being together physically after the marriage took place

You just need to follow the guide: http://www.visajourney.com/content/i130guide1

You don't have to live together. You include evidence to show your marriage is legitimate and your relationship bonafide. No trick, it's not too complicated. It just takes a long time to process!

Well this gives me a lot of hope but arent most of the interview questions living together questions? Also my stepsons case, does he need a G325a? He has no signature, he is3! This is so stressful and confusing

No. If you don't live together, they can't really ask about that. You can read interview reviews here: http://www.visajourney.com/reviews/index.php?cnty=Mexico&cty=&dfilter=5&topic=IR-1%2FCR-1+Visa

They're more likely to ask about other aspects of your relationship - when did you meet? how did you propose? tell me about his family? That sort of thing.

I think you should take a read of the guide, the interview reviews and maybe search the forum a little. You should find that it's not too hard, really. I'm not sure where you got the "you must live together" stuff from - almost all the couples on VJ pursuing a marriage-based visa currently live apart for significant periods of time due to the crazy slow way the USCIS processes petitions.

From what I understand, the interview questions are things that most people who are actually married should know about their spouse. But you're getting ahead of yourself. You have to file the I130 and get approval for that first.

Yes ok I understand. But as far as the 325a for my stepson, does he need one? How do I find out where to send them for their Visa medical checkup?

My other important question is do I need to be present at her interview?

Maybe click that link I posted to interview reviews in Mexico and see if people had to have their spouses with them?
