please i just want to know if we are to pay this money,a friend of mine was telling me that we dont need to pay,that we just need to fill the form and send it to the USCIS for them to review again and if it favour us,they will send the application down to lagos again,

we were denied on sep 5 this year and got the letter from uscis last month 22nd giving us 30days to reply them back if we want to appeal for the revorked of the visa application.

The letter you got from USCIS was it a Notice of Intent to revoke( NOIR) and it asked for you to submit evidence to the points they denied you on?

i dont really understand,but in it,it said there is noappeal to this decision,but we may file a motion to open or reconsider must be filed on form I-290B

If you had an interview and they sent the petition back then the notice you have says you have 30 days to preset evidence. about their intent to revoke the petition ? Or did you get a hard denial ( did you already respond once ? ) There is a difference to responding to a notice of intent to deny /revoke ( This is free to do but it is your one and only final chance ) If you have a hard denial then you can file the I290B but they are not something usually done without assistance as you have to prove through immigration law that the decision on your petition was improper. Usually people refile a new better petition rather than file the I290B

So the notice doesn't have the words "intent to revoke " ? Can you post what it says ( minus your personal data ) so we can help better.

Download the form and read the instructions. The form fee is $630.

The beneficiary can not file this form, only the petitioner.

There is a difference between appeal and motion to reopen/reconsider.

Understand what you are doing and let everything be crystal clear before you

waste $630.

The petitioner should consult a very good attorney and get clarity and guidance on how

to approach this.

If you can't pay the attorney to file the form then pay for a consult and ask the right questions,

this is too difficult to swing without at least a consult.

Yes, you have to pay. I don't know why the person told you not to pay.

Only Iraq and Afghanistan cases who have worked for the military are exempt from the fee.

It also states if you are unable to pay and have been exempt previously from paying blah blah blah

you do not have to pay but I am sure that does NOT apply to you.

You should scan and post the entire letter you received from USCIS here (black out personal data)

to make sure you received a hard denial or if you are confusing some general instructions that don't

apply to you in the letter. USCIS sends out the same letter structure for different scenarios.

Before you jump into an appeal/motion you must educate yourself of what exactly the letter you received is.

You can't go to step 2 if step one is unclear to you. SLOW DOWN.

Most of the time people receive a letter saying you are free to re file. I want to make sure the letter

you received is not misunderstood by you. Get your petitioner here on this forum to share in detail what

is going on as the petitioner not the beneficiary must file and may have a better grip on things.

This whole thing sounds like a letter following a NOID/NOIR to me. (Notice of Intent to Deny / Revoke.)

Petitioner needs to inquire if NOID/NOIR had been send or not and if the window of 30 days was missed.

Not enough details to help.
