Hi everyone,

So Im a Canadian citizen and I got a k-1 visa and married my husband in the usa (who is an american citizen). I lived in the usa for about 2 years with my husband and I had also got my green card this past june while being with him. Me and my husband decided to get a divorce not to long ago so I moved back to Canada only 2 weeks ago here. However we want to get back together thinking we made a huge mistake leaving eachother so I want to go back to the usa to be with him. I still do have my green card too and Since its not expired Can I just get up and go back to the usa to be with him without any problems?

Im pretty sure I can go back to the usa with no problems however when I was coming back to canada the canadian immigration officers kept asking me why I was leaving the usa and I explained I was getting a divorce and I just want to be back home in Canada. If i try and go back to the usa I dont want them to think its weird or sketchy wanting to go back to the usa only after 2 weeks and telling them it was because of a divorce.

Will I have any problems going back?

No problems.. A long as you have a valid green card you can return...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Technically, you abandoned your green card status once you return to Canada with the intent to reestablish residency there. However, to lose your green card status, USCIS would have to haul you in front of an immigration judge and prove that you reestablished residency in Canada. If USCIS doesn't haul you off, then you are fine.

In practical terms, USCIS has no idea that you moved back to Canada with the intent to stay there permanently. Get your ####### back here by showing your green card and tell them the truth that you are going home to be with your husband. No need to elaborate with details.

She was gone for 2 weeks! Nobody will ask anything... Not too much can be re-established in 2 weeks... Sounds like a cooling off vacation to me! OP You will be fine coming back with you GC
