Hi all,

I am on K1 visa , Just came on 4rth of Nov 2013 , Applied in a channel because i had experience . They just hired me but i told him everything at interview that i dont have social security number and license , but i have applied for it and i am gonna get it in 20 days. He was ok with this but now he asked for any document that shows i am legal to work here.


I know i could have applied for the work permit for these 90 days of visa , but i researched for it and if i would have applied for it , this takes 90 days to get it so its total waste of time and money ...


please help me i really really want this job.

You are NOT legally able to work (this was a stipulation of the visa you chose) you need to apply for EAD (takes about 90 days) so you cannot produce paperwork that says you are authorized to work becaus you are not... Sorry, you have to let this job pass by (and apply for EAD ASAP)

You've got to wait for your EAD or green card. Did you apply for EAD with your adjustment of status? EAD usually takes about 3 months to get.

You are not currently allowed to work.

file the Adjustment of Status WITH the EAD application nowish.

You cannot legally work until you have an EAD card or a green card (whichever hits the door first).

Sorry.

I don't know what decision process you used, thinking you could seek a job as a K-1 visa holder with JUST a SSN, but.... it was the wrong choice.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

OP - if you're not marrying your fiancé and adjusting your status, you need to be planning your trip back out of the USA before your 90 days, not getting a job.

Why do you need a US job if you must return home by February?

You need to leave the US and not overstay your K-1 visa. If you do not, then it will never be legal for your to live or work in the US. The ONLY WAY a K-1 visa holder can become legal in the US is to adjust based on marriage to the K-1 petitioner. Even if you marry a US citizen, she will not be able to help you because as a K-1 visa holder you can only adjust based on marriage to your K-1 petitioner.

If you stay in past February 2014, your US brother can never help you become legal. His petition for you would be meaningless because you violated US immigration laws.

You need to return home if you desire to once day have a green card.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You're not legally able to work. There's no two ways about it. You cannot until you get married and apply for an EAD. If you don't marry the petitioner within 90 days of your arrival, you must leave the country.

These are the facts and there are no different answers.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

OP, EAD is free for K1 visa when you apply for AOS so it's not wasting money.

21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

OP, EAD is free for K1 visa when you apply for AOS so it's not wasting money.

The OP was talking about filing for the EAD while his I-94 is still valid from entry on the K-1, not getting married and NOT filing for AOS--that IS a waste of money as it costs to file; takes about 90+ days to process and expires when the I-94 expires. From his other thread his has yet to be married--stay tuned.
