Yes they can and even from "First World" countries like the UK and Canada. Every time a member of my wife's family says they want to visit, we tell them that they have to go to the Consulate in Almaty and get a tourist visa. We will pay for the application, but they have to show that they will return to Kazakhstan and to not expect getting approved. So far we have had good luck, but an entire family cannot come so that they have a good reason to return. I wish the US would get rid of the whole guilty until you prove you are not trying to immigrant. It is very annoying that most of the people applying for a tourist visa will not use it to immigrate, but because of a very small percentage that do, all the rest of us are made to suffer.

As a result of this, visas are very hard to come by. Even using the VWP does not guarantee entry into the US as the CBP person can deny your entry if they suspect you are trying to immigrate to the US.

It seems that when citizens of VWP countries try to go for visitor visas, there is a high burden to show why 180 days is being requested AND WHY 90 days is not enough.

For non-VWP country visitor visa applicants, the why is 90 days not enough is non-issue.

Seems that the why is 90 days not enough could be a reason to deny the application which also ends the VWP privileges.

Didn't actually realise this was posted , my phone crashed as I was typing it

What I was actually trying to say visa can be denied if they don't think you have sufficient ties. I was denied a j1 at beginning of year and was legitimately working with permission from uscis and the university but my jetlag meant I didn't really explain how my job related to my degree enough. Basically I had been in the country for a year studying then was granted permission while out there to extend my stay and work in a field relating to my degree then I came home for Xmas and needed to get a new visa as my other had expired and was refused with no reason given.

I now realise it's because they think I had insufficient ties so I was pretty upset as all my stuff was out there and my boyfriend. I'm now the holder of a k1 fiancé visa so all is well but it was a real shock

While it may seem like this, it really all still does come down to the issue of "ties". If someone from a VWP country can spend more than 90 days in the US at one time, there has to be a question as to what there is to possibly draw them back to their home country after that. That's to day, if you can leave for +90 days, what do you have to go back to? If you can show sufficient reasons that make you leave the Us, the visa -- as with all other non-VWP applicants -- will be issued.
