Rfe response received by vsc on 11th july. Still waiting for approval. Can't even do service request until 60 days (11 September, this Thursday). Have lost hope for this remaining four days. Rfe was just to submit a copy of marriage certificate.that too they misplaced the copy of certificate which we submitted with i-130 in December. Their fault and we are paying for it. On top of that, rfe said we did not submit the certificate.they even put a blame on us. So frustrated and worried.

I am so sorry to hear what is happening to you. I can certainly understand your frustration. I am in the same situation as you, well I should say that my I-130 petition is still at the Vermont Service Center and I also had an RFE which VSC received the response on June 16, 2014. They asked me for a full translation of my marriage certificate and not a summary as I sent it. They only wanted the translation and I sent it very quickly back to them. It has been almost 3 months and no news from them.

On the other hand, my I-129F petition for my spouse was approved from TSC on July 11, sent to NVC and routed to the embassy and we already had the interview and visas were approved on the interview day and issued today. It is a puzzle to me how two service centers work, but I am thankful my K3 was approved and now we are just waiting for the passports to get back to my wife and daughter. I still have to deal with the I-130 since as soon as my wife and daughter arrive to the States I have to do adjustment of status for them.

It seems your petition and mine for the I-130 for some reason unknown are stuck at VSC.

I am so sorry to hear what is happening to you. I can certainly understand your frustration. I am in the same situation as you, well I should say that my I-130 petition is still at the Vermont Service Center and I also had an RFE which VSC received the response on June 16, 2014. They asked me for a full translation of my marriage certificate and not a summary as I sent it. They only wanted the translation and I sent it very quickly back to them. It has been almost 3 months and no news from them.

On the other hand, my I-129F petition for my spouse was approved from TSC on July 11, sent to NVC and routed to the embassy and we already had the interview and visas were approved on the interview day and issued today. It is a puzzle to me how two service centers work, but I am thankful my K3 was approved and now we are just waiting for the passports to get back to my wife and daughter. I still have to deal with the I-130 since as soon as my wife and daughter arrive to the States I have to do adjustment of status for them.

Hi,

I am so glad to hear you got k-3 approved and visa stamped. Since your wife and daughter can enter united states now and you can do the remaining process with them being physically with you , process will be less frustrating. Hope you get your i-130 approved very soon and then adjustment of status done for your wife and daughter.

There was another VJ filer from December who got RFE from VSC. RFE Response was received around july 16 or 17 and approval came around july 27.

Wish we had idea about how these centers work . Definitely not first come first basis.

I will keep you updated about what happens with us. We have kept a lawyer, for remaining process , who will file a service request on Friday.

Best of luck to you and all other December filers who are still waiting. April filers are getting approvals and we are in QUEUE.

Also, let us know if you hear anything about your i-130.

that is just the problem, because they do not tell us what type of security check nor do they give us a timeframe. It's just a waiting game.

At USCIS stage, they dont do background checks on Beneficiaries.

That was also my understanding until Info Pass lady told me that it may be the beneficiary whose security checks are taking time, more or less same information repeated by tier 2 officer couple of time. Also here on VJ members who believe that they can check beneficiary at USCIS stage.

Its all too much confusing, dont know who is right, the official documents, their customer service, or people :(

You are lucky that you got the 129f approved. It it because your both petitions were not at same service center. if i am given a choice to chose between k3 or cr1 i will go for sure for k3. Because chances to get in AP after interview are close to none. We are already suffered too much that we can not risk post interview AP.

But unfortunate my both petitions are with Nebraska and i know they are not gonna approve 129f ahead of 130 :(

Thanks Saumil, I am very fortunate my K3 got approved. I am glad you retained a lawyer for the remaining steps, I hope it helps you get something happening. I will also let you know if mine moves or anything happens.

I am sorry to hear both of your petitions are at NebrasKa. Don't loose hope, I know it is hard, but just keep the faith :-)

I think you are right about my situation, both of my petitions were initially at VSC and then the I-129F got transfered to TSC. At some point during my process I contacted the office of my representative here in DC who inquired on my behalf and received a response letter from TSC that within 60 days I would get an answer on both of my cases as it was already assigned to an officer. I waited and waited and nothing happened until the I-129F got approved. When I talked to the liason at my representative office again to inquired about the I-130s, he told me that both cases were at TSC which I did not understand how that happened as I only got notification that the I-129F got trensfered and not the I-130s, I asked him if he was sure and he asured me that he spoke to the congress liason at TSC and confirmed that both cases where there, Later I realized he was completely wrong since I received an RFE letter from VSC regarding my I-130s. After that point I stopped talking to the liason as I figured it was no help what so ever. He also told me what many people have said on VJ site that the I-129F was no longer being used and I should expect the I-129F to be administratative close. Luckily I didn't loose hope and it got approved beyond believe. Its approval has saved me about 5 months plus of waiting at NVC. I am really sad that people who got approved back in May before me are still dealing with NVC at this point. I really don't mind that I will have to pay the additional cost to do adjustment of status once my wife and daughter get here, I just want to be reunited with them ASAP and it is well worth the extra money I have to spend. I am sure if more people were given the chance as I did, I am sure they would do the same as I know you say you would too. I think USCIS should reinitiate it again and reunite families faster.

I hope your approval comes soon and that the process gets shorten at NVC and you can reunite with your love one soon :-)
