They could also confirm that they finished the background check on my wife (petitioner). Its so weird they would do background check right now when after all we have to send in all the police certificate etc at NVC that will confirm our records...

As i said "they are king of jungle" they can do anything...Even in their Privacy Impact Assessment Document they only talk about Petitioner's background check not beneficiary...see below.

As part of its benefits adjudication process and as required by law, the United States Citizenship

certain immigration benefits. These background checks consist of four separate checks against systems 
within Department of Justice (DOJ), Federal Bureau of Investigation (FBI), and the Department of

to complete background check processes, USCIS maintains five information technology electronic 
systems: the Fingerprint Masthead Notification System (FMNS), the Customer Identity Capture System 
(CICS), the FD-258 Tracking System - Mainframe (FD-258 MF), the Benefits Biometrics Support 
System (BBSS), and the Interagency Border Inspection System (IBIS) Manifest. USCIS is conducting 
this privacy impact assessment (PIA) because FMNS, CICS, FD-258 MF, BBSS, and IBIS Manifest 
collect, use, and share personally identifiable information (PII). This PIA replaces the previously 
published USCIS PIA for the “Background Check Service (BCS)” which describes planned background 
check-related systems that were never implemented. Upon publication of this PIA, the BCS PIA will be 
retired

See this line, they are talking about applicant who seek certain immigration benefits, and that is beneficiary...mean they do conduct background checks on beneficiary...

Can you define Applicant? on initial review stage this is what USCIS do

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators

Here they are talking about Petitioner/Applicant. I think both are same, the one who file petition and that is the US Citizen spouse, NO?

Small update:

My wife called USCIS and spoke to a tier 2 (for the third time) yesterday, she said she spoke to a very nice guy.

Anyway, he could confirm (like the three others) that we were delayed due to the background check, however, he said something interesting;

that most likely the delay was on Norway's end, and not the US, and that its Norway that is taking its sweet ### time to confirm my identity. He also said that this has happened with a few countries, but he could not disclose which countries.

Anyway, next step for me will be to figure out what institution here in Norway is in charge of giving this information to the USCIS and tell them to get their heads out of their a**es and get a move on!

Great that you had some info, however I wonder how much truth this does hold. They basically give a different answer everytime you call

or visit a usics office.....we are experiencing the same thing....very long story.... funny though how i'm still able to enter in exit USA without problem or got a nexus pass approved???? totally weird imo

in our case, it appears to be me, the petitioner who is the 'defective' one, but who know's as we can;t get a clear answer.

Still waiting patiently for NVC, Does anyone know anything about spouses coming over on a vistitors visa during this process or some other way ?? our son turns 1 this month and his papa really wants to be there.

Axs, get this we were denied our fiance visa due processing time that means we already went through rigorous paper work, all of this that we are doing again and that was approved with in 3 months but our marriage application is going on 10 months in back ground checks currently, non of this process makes sense and the more sense I try to make of it makes me sooo nervous, better to just step back and wait for the beauracratic bs to do its thing I guess.

If you're submitting an application to bring someone else (spouse, kids, etc) to the US, then you're a Petitioner. If you're applying for yourself (Adjustment of Status form, for example), then you're an Applicant. In any case, Petitioner/Applicant is the person whose name is on the application form. At USCIS stage, they dont do background checks on Beneficiaries.
