I basically got the same response from my service request. So I called and spoke to a tier 2 officer who advised that they usually say 6 months but it doesn't necessarily mean it will take that long. In our case he was able to give me more details advising us that the petition we first file for the k1 in 2012 was still open. After sending them a letter back then telling them we no longer wanted to proceed with the k1 petition because we were going to proceed with the i-130. We then got a response back that they have received my letter and once marrying my fiance at the time the k1 was no longer valid. Apparently that is not the case, because he said he still showed the k1 being active so they will need to look into this further and see why it wasn't close; however he was extremely nice actually taken over 40 minutes on the line with me looking into both cases for me. So am still keeping the faith. Come August 5 it will be 8 months and still no NO2. Keep faith everyone and am praying for us all.

CBO, does it mean K1 was causing problem? One should have told them about change of status so that they could close the K1?

I'm asking because i have a kind of similar situation...

My father applied me for F2A few years ago, Now as i married i didn't bother to tell USCIS about my status (Assuming after marriage i am already out of that category).

What do you think, is it causing my case to stuck in additional review?

Thought I should update you guys on our case status:

We sent an inquiry to our congressman on July 18th, who forwarded the request to USCIS, and we got an answer yesterday:

We also sent a service request about the delay in processing, and we also got a reply yesterday from the USCIS:

So basically here we have two different answers given. One is that the background check is delayed, and the other is that additional review is needed for the case. I do not understand why our case would require additional processing at all. We can't wait 6 more months for a NOA2, that would put us at 13 months and 21 days for NOA2 (which may or may not be a new record, 5 months average? HAH). Our next step is to contact the Ombudsman and set up an infopass appointment.

Good luck to everyone this week and I hope you get more encouraging answers from the USCIS then we just did.

This is utter nonsense and I'm appalled by the way that USCIS is treating US citizens who want to have their families with them.

CBO, does it mean K1 was causing problem? One should have told them about change of status so that they could close the K1?

I'm asking because i have a kind of similar situation...

From what the tier 2 officer told me this was the hold up with my case. They need to review my old k1 case, because it showed active so on May 27 they requested the file to review but have not received it as of yet. In your case just call to see if it is the same for you. I basically got a very nice tier 2 officer who was just honest with me

Just want to know if this is a possible reason why there is a hold up. Also for service request that just say that they are doing additional review. BTW, term additional review is a mystery and USCIS does not give any proper explanation about this term.

I hate it when they lie to us, Additional Review doesn't just mean security background check. It can be also be any additional information they may need to complete a case. Per tier 2 officer mines was reviewing the previous K1 petition. That is why I was so presistence and would not just take additional review for an answer. When I offered to even give him my old k1 petition case number he even had it up on his screen already and gave it to me!

They lie a lot and dont give accurate information. My personal experience.

BTW in your case as you were the petitioner your K1 was attached with your Name/ID. Mean you applied both cases thats why they were under your name. But in my case, one case was applied by my father and other case was applied by my spouse. So under my petitioner's (Spouse) name only one case will be shown.

This is our first case with the USCIS ever, for both of us. I've only applied for a B2 visa last year (that got denied) but that was at the embassy in Norway.

Other then that we have nothing on us that would qualify for an additional review.
