another I-751 section 4 question

My wife (the conditional resident) and I (the U.S. citizen) are filling out the I-751.

We have NO children conceived by us together or adopted children or any children living with us. From a prior marriage in China my wife has a 21 year old son and still lives in China. I have two adult U.S. citizen children from a prior marriage.

In I-751 Part 4, I will be listing all three children from our prior marriages.

My question is on my son: He was born on an overseas U.S. Air Base while I was stationed there. He is a citizen by birth. He was issued a Form N-560 Certificate of Citizenship. This Form N-560 has an “Application No. Axx xxx xxx.” It looks like an alien registration number but it is called “Application No.”

Should I list my son's Form N-560 Application No. in section 4 where it asks for a child’s Alien Registration Number (A-Number)?

Perhaps somebody else can confirm, but the I-751 only requires your wife's children (so only her 21 year old son), as your wife is applying to remove conditions, and it is she that is submitting the form.

Yes include all children and answer the appropriate questions correctly - "Is Child living with you" and "Is child applying with you" - in your case the answer is NO.

The citizens by birth do not have Alien Registration Number but only those that are Naturalized. In your case just leave that blank.

Why not - they don't cease to be children except that they are applied for in the application and that they may not live with the applicant.

I guess it doesn't matter either way because they either have an Alien registration number or they don't. In the instructions it does say for section 4 "dependent children who acquired conditional resident status".
