marriage never consummated

A friend of mine is married to a foreigner and is about to apply for his CR-1 Visa. She asked me a question about putting the I-130 paperwork together. The thing is she had a prior "marriage by proxy" (OUTSIDE OF THE UNITED STATES) which was never consummated!!! Now, is she supposed to include the annulment decree or not? Because technically the U.S. does not recognize marriages that were never consummated...if anyone knows the answer to this question we would appreciate the help. goofy.gif

Timeline

The question is what is the status of her marriage in her state. If her state recognised the marriage then it needs to be terminated before she is free to marry. Right now her current marriage may not be valid. and she may not have a petitionable relationship with her"husband" and she may be guilty of bigamy

This will not be over quickly. You will not enjoy this.

Some States I believe require consummation, the US as an entity does not govern this.

She will need to provide proof the previous marriage was terminated by annulment, divorce, etc.
