Entered US on B2 visa, now getting married, need help with documents

Hi! So I entered the US on my B1/B2 visa to visit my boyfriend. He proposed to me before I was supposed to leave, and we decided that we spontaneously decided that I should stay and we get married. I have no idea where to start. I've talked to a couple of people who have married US citizens here in the US, but they were all on K-1 visas. I've read through some threads, but I don't see anything particular that relates to me. If there's a thread that I might have missed, please send me a link to it and I would gladly do the reading. So, my main inquiry is, what should I do after the wedding?

Here are my key questions. I hope you guys can help me out. It would mean a lot to me. Thank you!

1. How do I apply for a SSN? Can I do that before filing the USCIS paperwork?

2. My fiance's income is just enough to be 125% above the poverty line, but then he has a 2-year-old son, and he's sharing custody with his ex. Does this mean we might need a joint sponsor?

3. We are gonna be living with his parents but maybe a month after we file the USCIS papers, we're gonna get an apartment of our own. Will that affect the process?

4. Since we don't have any lease, what document can we provide to show that we are living together?

You can get a social security number when you receive your EAD which is usually 3 months after applying for AOS.

There is a table somewhere that shows poverty guidelines for a household of 3 people (you, your husband and his son). You can decide after that if you need a sponsor or if his salary is enough on its own.

You need a lot of proof (not just a lease). A lease is very important and if you will live with his parents then a statement from them saying you guys live with them will do the job. You will need evidence of co mingling of finances( joint bank account,car insurance,health insurance, credit cards, bills with both your names or to the same house where you both live). The more evidence you send, the merrier. Also pictures from the wedding and different occasions.

If you move during your AOS process then no problem at all. All you have to do is file for change of address and call USCIS to tell them your new address. This is a very important step. CALL uscis as soon as you change your address.

1. Visitors are not authorized to work, so no reason to issue you a SSN before you apply for an immigration benefit.

After you file to adjust and get your EAD, then you are work authorized and can seek a SSN at your local SS office.

2. The son counts in your husband's household, so it's 3 - him, his son, and you. That means he needs to earn at least $24k a year. If he doesn't make that and dies not have countable assets, then you will need a Joint Sponsor.

3. No.

4. Affidavits from his parents that you two are living with them is sufficient to show you two live together.

However, sharing an address does not prove a bona fide marriage. You will need evidence of commingling life. Have him list you as his emergency contact at work. Have him list you as his life insurance beneficiary. Etc.

After your marriage, you need to go back to the philippines. It is also a must to leave within the expected date of leaving US. You are to be petitioned on a spousal visa when you get back to the philippines. You cant stay in the US because you just married your Fiance in the US.

After your marriage, you need to go back to the philippines. It is also a must to leave within the expected date of leaving US. You are to be petitioned on a spousal visa when you get back to the philippines. You cant stay in the US because you just married your Fiance in the US.

Please make sure what you write is accurate and true. As long as she came here with no intent to adjust status and stay in the USA then she can adjust her status without leaving the US. its a short cut and we have many successful stories on VJ.

Thanks for your responses. I now have an idea of what I'm supposed to do. We're going to the bank next week to add my name to his account, and then we're going to have one of his parents be our joint sponsor.

I have another question though. About the i-693, the medical examination. Obviously, I did not see the civil surgeon in my home country before I came. I have medical records and immunization records at home though that I am planning to have shipped here. Will civil surgeons here accept those records? Or do I have to have all shots done again? I'm in the medical field, so most of the required shots were given to me in school and while I was still working at home.

YOu need to call couple surgeons to see their price (big difference from one to another) and I think a scanned copy of your vaccinations is enough. Mine was sent by email and the doctor accepted that with no problem . I had to do 2 vaccines only.

For the co mingling of finances and stuff, everything counts. Have him add your name in any of his bills, have joint Macy ,target,walmart card. From now on you should try to gather evidence. Receipts of wedding rings, restaurants , honeymoon and trips. also, he can add you to car insurance and life insurance. you will still have time to gather all of this for the interview but its a good idea to have solid primary evidence.

Thank you for your advice. And right, I called USCIS, and my fiance went to USCIS personally last week, to ask if it was legal for me to stay since I did not know he was going to propose to me when I entered the US. They said it was no problem, we can just go right ahead, get married and start the AOS process.
