Hi guys!

So, I just received NOA (Transfer) letter from USCIS and just check my case status online and my petition was APPROVED! :-)
although I never receive letter from CSC, I just wanna prepare in advance the AOS and with the being said, I have an issue.
I, the petitioner is unemployed and was unemployed during the time that I filed my parents paper works. My husband, in the other hand is employed (US Soldier) and been in the military for 10 years now and we have a house that is on rent right now. I know that he can do the AOS in my behalf but, whats the first thing to do? What do I check and not on the forms? I am really worried to the point were getting a lawyer to do it is my option but dont want to coz of the fee :-(
Is there any one here who can show me step by step on what to do? I will really appreciate it big time. God bless you'all!!!

How do you file taxes? Jointly? You fill out I-864 and your husband fills out I-864a as household member. IIRC, active military only have to have 100% of federal poverty level in income.

There's a lot of answers to similar questions here. Check out the IR-5 timeline thread.

Read and study Form I-864 instructions. You need to fill-out and sign this form. Since you are unemployed you put 0 for your individual income for the last 3 yrs(if u were unemployed all those years). For the total household income put your husband's income that shows in your tax return. Your husband needs to fill-out Form I-864a. To get ahead, gather all supporting documents for AOS now.

Havent been through the process yet but I did some reading as preparation for petitioning my parents soon. What I know is you fill out I-864 and your husband I-864A. I'll have to do the same but not sure about your unemployment and active US military husband situation. Try reading the instruction for the mentioned forms.

offtopic45vn.gif Sorry that I have to ask this on your thread, but just noticed that you petitioned both your parents - question, did you mail out the petitions separately? Or separate but in ONE envelope/mailing? Thanks! rolleyes.gif
