So I mailed our AOS info this morning. But then I get to work and I get an email that says that a few changes are being made in the company and I could be laid off in the next 30 days. I make about 36000 annually for the last 2 years and then 25000 the year before that.

Its just me and my husband in our household...( he is from haiti) we were married in August 2013. I will get a severence package and will be able to draw unemployment until I can find another job.

QUESTION:

1) my mother said she will co-sponsor us if needed.... but she only makes about $27000 ( her job plus retirement) just this year and no income last year...will that matter that there was no income last year? Its only her living in her household.

2) Do I just have her fill out the info and we bring it to the interview or do I need to go ahead and send this in beforehand?

3) Will we really need a co-sponsor if my income was 36000 in 2013? What if the interview is in 2014 (which it most likely will be) I have no income for that..only unemployment and maybe my severence package depending on when it comes. How do they calculate if its so early in the year?

thanks thank thanks!!!

Hi!

I don't know what the correct thing to do is in this situation. . . But I did find some thread that could be helpful.

Since the requirement is based on current income, I would think that you would need a co-sponsor that is qualified. You can bring your mother's information to the interview or send it in ahead of time. Or both. Do you know if you will have an interview yet? I would suggest sending it now and then bringing it at the interview (who knows you might already have another job or even not be laid off...)

You could be approved without interview, and never be asked for any other info about your income and I-864. If you have an interview, it is still possible you may not ever be asked about your income. Bring all the current income documentation and any corrected/amended I-864s for yourself and a joint sponsor with you just in case, if you do get an interview. It is better to have them on hand just in case you were asked about updated income info.
