Hello all,


It's been almost a year since we filed our I-751. In the meantime, we have received and sent the RFE, and our case has been sent to the local USCIS office even though the online case status doesn't say that. We need your advice on how to proceed.


- I-751 package sent.

- Biometrics taken.

- RFE received.

- RFE documents sent.

- No response received from USCIS in 60 days. Opened service request.

- Received an e-mail from local USCIS office acknowledging service request and saying, "Your application was recently received at this field office and will be processed in the order received. We regret that we are not able to give you a timeframe for when we will complete the review of your application."

- Still no progress. The online case status says, "Your address was changed relating to the CRI89, PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED that you filed."

Two options. 1) make an INFOpass appointment to see what is up with your application and/or 2) file the N-400 to become a USC. Either way you will need to get the extension letter extended if planning any travel outside the US after the 1 year extension expires. You can do that when you are at your INFOpass appointment. You can also see if your congresscritter can be of any help. You need to start making a pest of yourself as one year is way too long for this to take.

P. S. You will get the standard wait 30 or 60 days before calling us or contacting us standard reply. Screw that, you have waited patiently for almost a year. Start calling and bugging them until you get results.

I personally suggest that he makes an INFOpass appointment and also get his passport stamped with extension for another year. Filing N-400 can be resorted later, if need be.

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Thank you for your suggestions. We will start with the INFOpass appointment and then file for N-400 when the early date comes up. No travel plans after the 1-year extension, so hopefully the 10-year GC will come before that. And I do agree with you that one year is way too long.

Filing the N-400 will force them to adjudicate your I-751 since you are now eligible for US citizenship. I think it is your best option. :)

When the N-400 is filled, does one receive a letter extending the CR conditions another year or should we still do what Navyk suggested and get the passport stamped via an INFOpass appointment?

Make an INFOpass appointment to see what is up with your application AND get the stamp in your passport. Then you can file for citizenship if you so choose. That way IF you should decide to travel, you can without having to scramble to get the stamp on short notice.
