Please i want to know if there is a difference between one his father petition for him for ir-2 visa before 18 and one petition after age 18 !?

Because i know USC petition for his children . one of them was 17 and the other one was 19 .

the children that was 17 make the interview after 8 months and still in AP for 1 year and now he receive his passport with visa .

And the another children that petition in 19 still till now without make interview and when he asked in NVC they said to him his case approved in he now must wait for the interview !?

My question now . Why the one under 18 make the interview and receive the visa before the one over 18 !?

No the one i talk about was 19 when his father petition for him and now he is 22 and nothing new done and he still waiting for the interview !?

his brother was 17 when his father petition for him and he now 20 and his visa approved and all done well !?

We can`t find reason for that !

they your thread was confusing, you should have asked under 21 and over 21.

but there shouldn't have been any problem anyway, because the date of petition should have froze and treated as child under 21 of a USC. they should have been the same.

If the child was 21 before the petition was approved then he would have already had an interview.

In his case it appears that he became 21 before it was approved and his category was converted to F-1, son of US citizen, and the processing time is longer depending on the country where he is from. At least 7 years wait.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

For the child under age 21 who is an Immediate Relative of a USC, CSPA freezes the child's age on the Priority Date.

Subsequent approval of the I-130 is irrelevant.

There is no aging out into the F1 category since the child in this case was 19 when the case was filed. He is 19 for immigration purposes because his age froze on the day his USC father filed.

The cases for the 2 sons are independent. Maybe one had more of a background problem than the other. There is no way to know why the older brother is still in AP. It's pure speculation to guess at a reason.
