I am in the process of gathering documents for my I-751. Jan 22, 2014 is the last date to file this.


So far, I’ve gathered the following.


- Medical Insurance from my employer showing my husband as my dependent


- Life insurance policy showing my husband as a beneficiary


- Added my name on the car title


- Photographs


- Affidavits(notarized)


- Vacations - itinerary, photos


- Facebook profile printouts


- We stay with my in-laws, so we have no rental or utility bills in our names. My husband and mother-in-law are listed on the utility bills. I have a copy of that. A letter from my in-laws, who owns the house, stating that we have lived there since my arrival in US.


- My husband is still in school full time and works part time on and off. I work full-time and I take care of all of our expenses.We didn’t have a joint account. We started a joint account in mid Nov. We only have statements from then.


- Invitations and mail addressed to both of us.


- Enough proof to show that in the past two years, both my husband and I have been using our current address.




- Last year , we filed our tax returns as married filing separate. Yes, we are a genuine married couple , and no, we don't have a profound reason for filing separate.


I am afraid that this filing status might be a red flag.


Should we amend our return to be married filing joint? When we consulted a tax professional, we were told that it will take about 9- 12 weeks for IRS to process our amended return.So, do we just send the amended return with our I-751 packet while IRS processes our return?



Are the documents that we have so far going to be sufficient? I have no other documents to submit.



Any help will be greatly appreciated.
