Hi,

I am in the Cr-1 visa process and I am waiting for approval from USCIS. I am a university student and I work part time at a preschool. Lately my grades have been suffering and I want to quit to be able to focus more on school. Even with a job I would need a cosponsor and I have one. If I dont have a job will that effect our approval for the visa? Has anyone been approved without a job?

Hi,

You do not need a job to have a visa. I am also a university student and am not working. You will definitely need to find a co-sponsor though. Also, even if you do not have a job, you have to provide uscis with your financial information, you need your tax forms from the past 3 years, when you did work, also if you do not work now, how do you support yourself. Also you will need similar things from the co-sponsor, including their proof of citizenship amongst other things.

This is what you will need after approval

AOS Packet

a. Bar-coded cover sheet

b. Completed and signed form I-864 by the petitioner

c. IRS tax transcripts for the last three years

(Call IRS at 800-908-9946 to order them for free)

d. Petitioner's employment letter

e. Petitioner's pay stubs for the current year

I was approved without a job. Granted, I got one immediately after the interview but that doesn't really count at all I guess!

A co-sponsor is sufficient but they might ask your husband where you are going with your life and what you're doing, which I'm sure he already knows but just refresh each other on your proposed 5 year plan just in case they do ask so he can be prepared smile.png but as long as you meet that requirement I think it's smooth sailing from there.

- Dec 13, 2012: Cleared check & NOA1 later in day

- Dec 18, 2012: NOA1 (hard copy) received in the mail dated the 12th Dec

- February 26, 2013: Petition is being transferred to another office

-February 28, 2013: Petition was received by unspecified office and alien registration number was changed.

-March 04, 2013: Called USCIS & found out our file was transferred to California Service Center.

-June 4, 2013 NOA2

-June 6, 2013: NVC Received petition

-June 19, 2013 : Petition left NVC

-July 3, 2013: Packet 3 Received (via email)

- Aug 13 2013: Interview Date : (Rescheduled for a later date)

- September 25, 2013: New interview date, initially approved but put into AP for insufficient co-sponsor.

- Sept. 25- Nov. 20th 2013: In AP due to insufficient co-sponsor

- Nov 21, 2013: CEAC website says visa is Issued :) YAY!

- Nov 26, 2013: Visa in hand dancin5hr.gif

Another question. Were you living on your own or with family? sorry if to personal I just dont want to risk getting denied.

I live with my mother! I was really worried too to be honest. I am going to school to be a nurse and I wasn't in a position to have an apartment especially since personal family drama went down and I had to quit school momentarily and get a full time job to pay the bills (but that was taking place only a few months before our interview so I wasn't working when Ahmed had his interview) Ahmed and I talk about everything though, the good, bad, and the ugly. So I knew he was prepared to defend our relationship and our situation. We know that some people whether they're counselor officers, friends, or even fellow VJ members who would say you need to have this, that, and the other to get approved. Maybe in other people's cases they did but we are just starting our lives and we are working towards that independent married life so just make sure you can defend your situation and prove your maturity. I also made sure to really illustrate the support of me and Ahmed's family's in our petition because I felt like the fact that our families are supportive and willing to stand with us throughout this marriage was a big dynamic of our relationship. But I'm sure your file will prove that maturity and intent to continue bettering your future smile.png I'm about 98% sure they decided that Ahmed was approved even before he came in. I felt like they took the time to go through our huge file and made a decision based on what I provided.

Every case is different though, so just make sure you have all your bases covered and insha'Allah you will have a positive outcome. I know we went through separate processes but you can PM me anytime you want about any questions if you feel like they're too personal to ask here!

The joint sponsor can be anyone, USC or LPR who is residing in the USA and meets the poverty guidelines for their household plus the immigrant. You do not have to live with them. You do not have to be related to them.


You also do not need to have a job but you will also be required to file and I-864 and be the primary sponsor of the beneficiary. The government will come to you first to get their money if the beneficiary uses means-tested benefits that are not allowed.
