Proxy marriage back with an answer

I filed last year my I 130 for my spouse and I got an answer last august asking if the marriage was consumated,but it wasn't consumated at that time.so I refilled a new one in September with all the evidences that it is consumated

Now.

I got approved last Friday.

The question is I didn't get any answer yet from the old one.is that ganna affect the new one.plz I need an answer.thanks in advance.

This doesn't make sense...

1. Why would USCIS ask if your marriage was consummated? Is that even allowed?

2. What evidence would you provide indicating it was consummated? (and I really don't want the answer to this question lol)

Do you mean they wanted evidence of a BONAFIDE marriage? If you provided that, there shouldn't be an issue with the old one

02/05/2013 NOA1 Priority Date

04/09/2013 Called USCIS-informed by Tier 2 officer that my case was transferred to Washington D.C. on March 13

09/05/2013 NOA2

09/27/2013 NVC received case

Submitted DS-261

Paid AOS bill

10/16/2013 Paid IV bill

10/19/2013 Submitted DS-260
10/21/2013 Mailed AOS and IV packages overnight

11/15/2013 IV package accepted/Checklist for AOS

11/26/2013 New AOS documents received at NVC

12/19/2013 Case Complete

12/27/2013-Received Interview letter

01/26/2014-Husband's Medical Exam

02/13/2014-Interview- Approved, but the consular officer did not see I-864 joint sponsor documents, and sent my husband home with the packet of all the original documents, and told him to mail it in when he gets it. My husband realized that the "missing" documents had been there all along. Husband immediately mailed it back.

02/26/2014-Consular office received "missing" documents and gave it to CO for review

03/17/2014-Visa Issued!

03/20/2014- Received Visa

03/21/2014- POE!

They can ask in a proxy marriage.

i would not worry about the old petition submittal,

as the new petition was approved already and will be sent on to NVC.

At least, don't worry about it for now.

Later, on interview day, be prepared to answer all questions about the prior petition.

IMO, yer good, as you consummated the marriage prior to filing the 2nd petition, and this 2nd petition was approved.

However, just cause I said so, means nothing wink.png Hopefully others will chime in.

Specifically for a proxy marriage, consummation is best done PRIOR to filing the I-130, most petitions are approved when consummation is mentioned in the submittal.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
