It appears that your consulate may know of a cultural norm to not formally terminate marriages. ( common in much of the world ) As earlier mentioned you would have qualified for a DV visa married or not, you did NOT violate the rule about not adding relatives during the process. The are looking for the truth. As I mentioned earlier tell them the truth, when you lost faith in the marriage, when you got back together and why. You may or may not get a visa now but it is doubtful they will take your green card away. If lying to immigration caused that half the people that AOS from VWP/B visas lie and get away with it every day

This will not be over quickly. You will not enjoy this.

Yes, I agree. In most countries over the world dispute does not mean divorce. I did not get along with her for a while but we still lived under the same roof with all family members. Everyone was trying to re-conciliate between us, I can say it was on and off.

At the end of the day, I will tell mention the reasons to them and no matter what will happen.

The question was about a legal situation, not about whether you loved your wife that day. No matter your feelings, any on and off relationship status, legally, you were married. That's what the question was about.

You are still dancing around the issue.

I read all the responses in this thread and I was a bit surprised to read some harsh comments from few members. I believe every one is entitled to a second chance, the guy's mistake was to omit his family on an immigration application for reasons he explained, it's not like he killed someone or committed a crime. It seems that the CO was more indulgent than most of those who responded in here. I am not sure what the outcome will be but I earnestly hope there is a happy ending to your problem and can live the American dream together with your family.

I totally agree with this, I was going to write the same. IO decides to approve or not the case, and if he is asking for more evidence, it's more likely not to deny it. And there are always exceptions in any instruction or rule. In my recent interview, I didn't have the IRS trascripts, and the IO just waived it, and approved my visa. So, good luck!

UPDATE (IV VISAs ISSUED).

Please see below:

My wife and daughter had an interview on Dec 5th 2013, the CO asked for more documents (Statement from me, DNA test and Wedding Pictures). We provided all these, the case was under AP for more than 6 months. I did E-mail the embassy on June, a week later they called my wife and asked her to bring the passports to the Embassy.

06/20/214: IV visa status changed from AP to ready.

Few days later (06/25/2014), the IV visa status changed to ISSUED.

07/10/2014: The VISAs are in hand.

I would like to thank every one who supported me with nice comments.
