Hello friends, I petitioned my mom and she arrived Nov 6 here. Although she have not received her physical green card yet, I understand the stamp will serve as her green card. My questions are: 1) we would like to petition my father and my 17 yrs old youngest brother, can we start filing for petition without her actual GC yet, as a petitioner?

2) what forms and kind of visa she needed to petition her husband (my dad) and her youngest child. 3) does she needs to look for job to be able to petition? (My husband and i would like to provide proof of income)

The questions above could have been asked before, I just could not seem to find the similar situation.

she can file the i130 for both of them

why didn't you file for both paren'ts at the same time, is it not to leave your 17 brother alone?

Hello. Thank you for the reply. I have no idea we are suppose to pay $165 for the card. The letter given to her stated that the GC will arrive on mail. Are we suppose to pay for the card?

Yes, we rather have one parent to be with him as he is in school still.

Is the I 130 petition for each person or just for my dad and the brother as a derivative?

If you are joint sponsoring then she doesn't need to be working.

Everyone who immigrates to the USA needs to pay the New Immigrant fee. (K1 and K3 and AOS do not have to because they are non-immigrant visas/routes.)

She has a green card btw... Her endorsed visa is her temporary green card for up to 1 year.

It looks like because of the category, your little brother doesn't need his own petition but can be a derivative of his father's.

I think your father and brother are eligible for follow to join benefit? How it did happen that you only petition for your mom? Anyway yes your mother can file petition for your father using the visa in the passport with admission stamp. Thats what i used when i petitioned my daughter.

This post may be under the wrong heading. OP petitioned her mom. Only US citizens can do this. (This thread should be moved to Family if USC).

When a USC petitions for a parent, only the parent gets a visa. The parent's spouse and children are not eligible for visas. So, tree is no follow to join path. Mom can petition for her husband and child, but she cannot request a follow to join.

You have to pay the $165 for the actual green card.

1. Your mother can petition for her husband using the temporary I-551 (green card) from her passport to petition for her husband. The husband's 17 years old son would be included in his petition. So, one petition for husband will cover him and his son. Mom would only need to file separately for the son if her husband is not the father.

2. Read the instructions. I-130, copy of petitioner's green card, marriage certificate, birth certificates, G-325a, and proof if the relationship. Remember, mom will file for dad. The petition includes the son.

3. Mom does not need a job. A Joint Sponsor (you) can meet the I-864 requirements.
