Hello everyone:

I'm new to this site.

Sent applications (I-129F etc) 7/5/13 and receive my approved I-129F petition 10/10/13 from NVC and forward to the Consulate. We are both deaf and my fiancee is in the US. After I got approved and complete DS-160 to apply for a K visa. My fiancee got other approved I-129F 11/15/13 from USCIS (I-797 NOA) valid until 1/19/14. I paid for my I-129F fees online and schedule for my interview 3/24/14 at Montreal Consulate. Unfortunately, my approved petition valid until 1/19/14 and interview schedule already ahead of my valid date. I sent email (Dec 3) to Montreal Consulate request for emergency expedited appointment and it takes about 21 days for Consulate to respond back.

Do you have any suggest? Should I go to P.O.E with my approved I-129F and medical exam to issue a visa before my approved petition expired?

Hi there,

You do not need to worry concerning the validity date. At the interview the CO will automatically give you an extension. That is what happened for me. My petition's validity was only good till around the same date as your and my interview was in February. At my interview I was approved and am now in the USA. No need to worry about this. On a side note, you would not be able to be issued a K-1 at a POE as you have to go before a Consular Officer and then the Consulate prints your visa. I know that certain non-immigrant visas can be issued at POE's but K-1 is a non-immigrant/immigrant visa.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello, I'm grateful for your respond. Right now I'm relieved. God so good. I was on vacation visit Deaf church in Puerto Rico and met my fiancee. I read your profile story. God so good. I have some questions to ask and take your time to respond.

Should I complete DS-260 and 261?

When is the best time to schedule for medical exam before interview date? The medical certification is valid for a period of 10 calendar days from the date of issue. After that period, the certification will be considered invalid? is it true?

The best time to schedule your medical would be as close to your interview as possible, but have enough time and then some to receive your results back for the interview. Usually takes 3 days to get the results back. What happens is once you get the medical and then the visa gets approved, the expiry date is 6 months from when you got your medical. I got my medical done on January 7, 2013, my interview was Febraury 26, then once my visa got approved, the visa was good until sometime in June or July. The medical is not good for only 10 days, once you get your medical back I would suggest making a copies of the worksheet (DS-3025) that the Dr. fills out for you. You may or may not need the DS-3025 for AOS once you move to the USA. What I would suggest is that once you get here to the States and are in the AOS process PM me with a copy of your DS-3025 and I will give you further instructions on whether you need a Civil Surgeon to transcribe the record for you or not. As long as you apply for AOS within a year of receiving your overseas medical you will be fine concerning AOS.

As far as the DS-260 or 261, it would be the DS-260 that you would fill out and you need to take a copy of the confirmation page along with all the other proof of relationship, etc to the interview.

Thank you for your respond once again. I resign work last month and my apt rental contract expired. I lived in Toronto and move back to Windsor for temporary stay. One problem is I couldn't find USCIS approved physicians in Windsor. 3 approved physicians in GTA from MTL US Embassy list. Are you familiar with physicians in Windsor? I will book for medical exam a week before my interview date.

The only approved physicians are the ones listed. Toronto would be the closest for you unless you get your medical done before your interview in Montreal. In that case you would need to spend 1 wk or 1wk and a half in Montreal depending on the day of your interview so that you can get your medical done and back in time for the interview at the Consulate.
