In the US while filing for the IR-1 / CR-1

Timeline

Hi - hope someone can shed some light. I am currently in transit in the US. My husband and I work on ships together and are joining our ship this weekend. I am currently in transit (I'm Canadian), visiting his parents and putting the packet together before joining the ship in a few days. The 1-130 asks if I am currently in the US, which I am, but not working or living, just passing through visiting on my way out and I do not require a VISA to do either of these things. We want to mail out the packet before joining and are wondering if that is going to be a problem. The only thing left is to take our passport photos and mine will clearly have a US address stamped on it - I don't want to break any rules, just wondering if that's a problem...Any advice?

It's not a problem, for the questions about your visa, put "Canadian visitor."

I would not send it in till i get out. if i were u. i was there after my wedding and waited till i left to send my husbands i130. i am now approved.

You should correct your timeline... Was your service center really the Texas one and did you really interview in Armenia?

But there is no problem to sending the I-130 now, none whatsoever. The OP is leaving, isn't trying to adjust status, why would they have to wait to leave the USA and be on a cruise ship to send mail?
