Hello everyone,

I need your help .... I'm about to file for AOS but I got some questions about my case

1) I got married to my wife with her real name (name on birth) but all her papers have still her ex husband name on it .... which name should I use on the paperworks?

2) me n her dont live together because she doesn't wanna lost her government benefits ( they gonna cut it off if they know that im luving with her) meanwhile im living with my folks till I get the EAD then a job since I can afford the bills with her .... is that a good reason to tell the IO why we are not living together? ... any suggestion?

3) I dont wanna use her address on the paperworks as the mailing address ... can I use my address instead?

Are you trying to AOS from a spouse visa or a tourist visa?

1) So, if when you got married, what your marriage certificate says under your wife's name is "Mary Smith", then you fill all the paperwork with the name "Mary Smith", a lot of the forms will also ask that you include other names used, where you will include "Mary Jones" or any other name she went by. It is absolutely no problem that she has a lot of documents with names other than "Mary Smith", the marriage certificate is enough.

2) I am not familiar with this issues so I don't know what to say, sorry. As a general rule, you should tell the IO the truth, at all times.

3) If you truly report where she is living as her living address, then you can definitely put any other mailing address as you wish.

As Franciscus said use the name on the marriage certificate and just list the other name she has used, this should be minor, just keep it consistent, so if on the Marriage certificate its Jane Doe and previously she was Jane smith, put Jane Doe 1st and Jane smith as name also used and have that consistent through all the forms.

For your 2nd point you should tell the truth, however the truth may likely open you up to a lot of questions and doubt.I'm not sure what approach you should take but be honest and probably state that once you get the EAD then you all will live together and she will be off government benefits.

11/07/2016 [Day 0]: 1st day of the 90 days, N-400 eligibility based on the married to a US Citizen for 3 years rule

11/08/2016 [Day 1]: Package delivered to the Dallas Lockbox by USPS Priority Mail, confirmed via tracking
11/10/2016 [Day 3]: Pending Fee to USCIS for $680 on my Credit Card
