can i request a second drug test?

But they don't seem to, which befuddles me.

Here's what I think.

Beneficiarys don't do enough research and leave it to the petitioner who may not really know the going ons with the beneficiary.

You would think the beneficiary would be the one doing MORE of the research, since it's their life that is being scrutinized before they get there.

09/12/2013 (Day 0) - Sent AOS packet (I-130, I-485, I-765)
09/13/2013 )Day 1) - Delivered to USCIS Chicago
09/17/2013 (Day 5) - Received USCIS Acceptance texts and emails
09/18/2013 (Day 6) - checks cashed
09/21/2013 (Day 9) - NOA hardcopies received
09/25/2013 (Day 13) - Biometrics Letter arrived. Scheduled for Oct 11
10/11/2013 (Day 29) - Biometrics Appointment completed
10/17/2013 (Day 35) - Text and email received, status changed to "testing and interview"
10/24/2013 (Day 42) - text and email received, "we mailed you an appointment notice for an interview for November 26, 2013"

That's certainly how I felt, as the beneficiary. I read everything I could!

Thanks for all your replies.

Firstly the doctor was being an ####### with me, when it came to drugs and alcohol she kept asking me the question, again and again. I SAID NO. I may have come across a lil rude when I answered it for the 3rd time.

Why would a Dr. patronise you?, I was paying them for a service.

Im Asian, 29 and a muslim. (only saying)

Passive smoking - well I drove down to London with my mates the night before, and they were smoking all the way, in a car for 5 hours. Which now im certain it has to be that. Like I said all my life I have been around smokers. To me it is the norm. I am 100% confident I will pass another drug test now. In either case I have spoken to my GP and have scheduled a drug test this week. The results I will take to the interview. From what people are saying these tests have no weight or meaning but I will try - Knightsbridge have not rang me back yet with the results of the further tests. From the research i have done, no test is 100%, they accurate but not 100%. some say passive smoking can be a positive and some say they don't. Im no Dr but i aint going to take one test as a concrete result. I will fight my corner.

Why would I do research on a drug test if I've never taken them ? If i had known there was going to be a drug test, there still would be nothing different that i would have done.

What exactly happens on the interview with the medical results? Will I get a chance to explain or will it be a simple No?! Is it up to the interviewer on the day to make a call on this? or the dicition is already made ?

The Mrs cannot travel, she has her chemo ongoing. I cant bear the thought of a year not being with her?

can I travel to the USA now with my ESTA before the interview so atleast I could see her before this one year ban happens ?

Ha at my medical being lost, i aint that lucky. - ps what courier do they use?

Dude it matters

not how the weed got in the system

that pamel Dr puts it in his/her report...U R going

nowhere for one year.

Whether its weed cookies, chillum party and U stay

in the midst, or some weed tea for asthma, there's no

2nd chance to test....and really You may not have

smoked but a roomful of spliffs..,yes can show up.

being arrogant with Dr or CO will not help either.

These panel Drs want to keep contracts, get the money

in a year he get another fee again, they will have no

mercy regardless what you say...they have to report it.

The drug test from your GP, days after you failed the Knightsbridge one, isn't going to do you any good. London embassy ONLY cares about the results from Knightsbridge. You could have an army of doctors with test results, it's not going to matter.

Your ESTA/VWP is probably already cancelled, if not already, it will be once the embassy gets the Medical results, which will happen on Monday, if they haven't received them already, which they may have.

You really don't have any options but wait the year and pass your quarterly tests.

I feel bad for you, but for the life of me I can't fathom why you'd even go NEAR anyone who was smoking with a visa process ongoing.

I feel so bad for you and even worst for your fiance....i just hope and pray that things will work out in you guys favour....one of the worst thing is being accused of doing something that you know you didnt do....well there is a higher power and all i can encourage you to do is pray...pray and pray...that some how you will get a break and find a way to be with your ill fiance...

Hi thanks for all your replies and support.

an update....

so the Dr rang finally stating the lab tests have come back positive, and is very high, not passive smoking. She mentioned sorry etc and will be sending the medical report to the embassy. I stopped her right there and questioned everything about the test etc, also I still stayed firm confirming my innocence of not smoking and baffled to why the results have come back positive. I could not take NO for answer, and a sorry from the Dr ?? not having it. I wanted to speak to the superiors. She mentioned she will speak to rhe panel of Drs and come back to me.

A few days later she rang stating they have spoken and with all the research they have done it is positive and they cant do anything. Not going to take NO for an answer again. Id like to present my own case to the panel. Id like to battle my own fights rather than leave it in someone elses hands.

That afrernoon A senior head Dr from Knighsbridge rings and advises me of the above, I presented my case, my points and now they have referred me to a drug specialist in Chelsea who will decide, The cost of this doctor I will be absorbing, not including all the travel costs coming back down to London etc (on train this time). This Dr is £300 a hour. I will for sure looking to be refunded every penny once proven im in the clear.

My question is, has anybody been to this drug specialist ? what am I expecting? The appointment is tomorrow. I cannot wait to finalise this as this medical is still pending for two weeks.

I've never come across anyone in the UK going as far as seeing a drug specialist. I think you'll have to report back and be the information provider. :)

I think you have miraculously been given a second chance if the Knightsbridge doctors have referred you to the specialist (If I am reading you correctly). To me, the Embassy will absolutely ignore your doctors, but would have a hard time ignoring Knightsbridge's own specialist. You MUST win with this specialist or you are doomed for a year. I would go over everything in detail, including telling him/her about cancer-stricken fiancee (any empathy will help you). Best to you and to her!

P.S.: I would demand a second test. Then , if the results come back far different, you may actually get the specialist on your side saying your THC levels could not drop that fast, and the first test must be in error. I have seen this be effective in drunk driving cases.

Well... that's an interesting turn I suppose. It's great that they're going to send you to an expensive specialist. However, what's not clear is even if by some miracle the specialist finds you clean, whether the embassy will care about the results. I'd be surprised if Knightsbridge hasn't already sent the results to the embassy. It seems they're really rather sure of the results. Taking a new test two weeks later no matter who does it seems to me the embassy isn't going to give two hoots and a button about.

I'm not sure how much hope I'd give to that reimbursement, either.

I was the same way. My fiance even criticized me at the time for being obsessive and I had members on here telling me to calm down, haha. My dad had a heart attack Dec 2012 and they thought it might possibly be a genetic thing and I had depression as a teen, so I went to my GP/hospital and got pretty much every test I could think of. STD test, blood test, chest X-ray, ECG (they wanted to check my heart was alright), GP stuff for past depression. I knew I SHOULD have been alright, but I wanted to go into Knightsbridge 100% confident and know for a fact that nothing was wrong with me. I even told my doctor that I'd taken an anti-allergy pill that morning just in case, she said she was only testing for syphilis.

OP, I hope you get your situation sorted soon. I can't understand why you'd be around pot smokers so close to your medical, but I empathise with your situation and I hope you fix it so you can take care of your fiancee sooner.
