Hi

I went to my medical yesterday and they asked for a drug test. the doctor has rang me back today saying I have been found positive for THC. I don't smoke, I have been around friends who smoke for all my life, not only that it was my birthday a few weeks ago and we had a mad party, thinking it maybe my last with them - I did not smoke in that party also. passive smoking all my life.

can I request a second drug test? how accurate are the drug tests? I cant believe this could hinder my chances for the visa.

pls help

Thanks in advnce

Even if it's from passive smoking, as you say, there's no reason the results will change. If it's in your system, it'll still be there now

Declaring drug use, or being found positive for drugs, will trigger a one year ban. You'll likely have to refile your case in a year after completing quarterly drug screenings (and being found clean) when declared inadmissable at your interview.

You can call and ask if they'll retest, but I shouldn't think it likely.

How Effective Are Marijuana Urine Tests?

Although false positives are common for other substances, they are rare for marijuana due to the sophistication of today's tests. The laboratory first screens the sample with a immunoassay test, known as the EMIT or RIA. If positive results are returned, the sample is again screened with a gas chromatograph mass spectrometer (GCMS), which is much more accurate. That's why false positives are rare.

Do you drink herbal tea? I have heard of false positives for herbal tea.

Of course the big red flag for the false positive is the pot parties you attend, with the second hand smoke in the air. If you manage to get so a second test or quarterly tests or whatever, you need to steer clear of these pot parties and breathe clean air. They are not going to accept "I don't smoke pot but I go to parties where it is smoked".

If by herbal you still mean pot tea. :P Wishful thinking.

From the link above:

"No known substances would cause a marijuana urine test to return a false positive. At one time, ibuprofen -- sold over-the-counter as Advil, Motrin, Nuprin and others -- would cause false marijuana positives. But today's tests have been adjusted to eliminate that problem."

1 year ban plus all the other expenses during the year. If I were your SO I would be livid at your callousness.

Particularly sad as the OP's other topics suggest there was some urgency to wanting to move: http://www.visajourney.com/forums/topic/456937-k1-visa-breast-cancer

Likely not going to be able to emigrate until 2015, now, what with also having to refile the I-129f and await that processing.

thanks for all your replies.

I have never smoked marijuana in my life. im not lying about this. I can understand peoples objection about this as drug test has come positive but I haven't and I would know If I have. I cannot understand how passive smoking can make my drug test be positive. I am 100% certain if I do a second drug test it will be fine - It has to be due to my birthday being so recent and all the smoking which went on - I did not take a single puff ! Can I request a hair drug test ?

My fiancé is absolutely livid, she is fuming mad and upset. I have been with her for 5 years. She has breast cancer and I cant believe what im putting her through. she does not deserve this. This year I wanted to make our dreams come true.

The doctor did say she will call me next week as sent for further tests. Ive not been able to eat or sleep, I cant stop thinking about it. I cant wait for a year, a ban for a year means I cant even travel to the country ?

Only God knows what the next year holds and not be able to see eachother will affect her so much, I can bear to just think about it.

Yes, passive inhalation can trigger a positive test.. It is not a false positive as you were exposed to it even though you did not personally or directly inhale... I am so sorry! It is an uphill battle for you for retest because you cannot after all say "I think it was being around smokers at my mad birthday party". You will most likely incur a 1 year ban and have to undergo drug tests every 3 months. Unfortunately, I think it might also void your ESTA and thus VWP (but that I am not certain of, you can still try). Unfortunatly, some decisions we make have very real, and very terrible consequences... I wish you the best.

This topic has been discussed every 3 months on this board, and every 3 months everyone acts as if they have never heard of drug testing being done, or " not my country" only the countries that all informed people wants to assume it shopuld only happens to. I have said this many times from my last 7 years on being on this board, DRUG testing is done in every country, some are lucky and some are not so lucky.

Please refer to this link, from 10/2013 http://www.visajourney.com/forums/topic/459903-denied-fiance-visa/

The nasayer can say what they want, but I iknow for a fact that drug testing is done in ALL countries. Not just undeveloped countries as some on this board wish to believe.

There's some discussion about whether poppy seeds can trigger a false positive, as well.

Either way, I would think you could get a second test on your own. If it comes up negative, with such a small interval between tests, you could potentially question the validity of the first test. This is all hypothetical though. I have absolutely no clue if it could work.

Even if it was just passive smoking, what would a second test do? If it's in your system, it's in your system. It's unlikely that a second test will give you different results, but I guess go for it. Nothing to lose (besides money)
