I just got off the phone with a tier 2 rep, he explained to me that there was a back-log of a year or more for I-130 petitioners. My case was transferred to my local field office in late August and as they are supposedly working on February filers at the moment, who knows where my application is buried. I am trying to remain optimistic... he was able to put in a service request for me, the first rep I spoke to lower-level was able to put in a service request as well, so that makes it two of which I should hear back from within 15 days. My stomach is in knots. Has anyone had any success in expediting their case after a service request? I don't know what to expect from here.....

If it is at your local office, try for an info pass. That way you can talk to the officer in person and probably he can work on your file.

Also have you received any transfer notice on your case?

I didn't even know it was in Newark until I called USCIS and they told me it was there. Then I received a letter from the Newark office stating the case is pending adjudication back in September. I was told all I can do is wait because they were backlogged. Heard nothing since until today they said I am behind 1 month that February filers are currently in review. Yes I am sure its in my local office, thrice confirmed by USCIS Tier 2, but no notice of transfer was ever sent. Infopass is a great idea, however I work a fulltime job and currently have no days to take and appts are booked all the way into February.

When you filed it was normal for cases to be sent to the local office without a notification. Most of us filing from Aug 2012 to Jan/Feb 2013 were sent to local offices for adjudication. There was a lot written on the boards about this and if you look on the USCIS alerts section for Sept 2012, you'll see the notification there about sending to local offices without notification to final destination. Newark was/is a slow and rather backward office (look up user N-o-l-a for her adventures with them) office and so you kind of have to wait but getting a service request in is a good idea. It's not a bad one either to try and contact your congressman's or senator's liaison either.

quick question.. are you on the K3 route? did you ever file an I-129F as well? because according to your timeline you have not.

You can also request to expedite your case since it is behind the schedule, and I remember reading in VJ some other user doing the same.

Ask a USICS officer to expedite.

Anyway it looks like you are so close to an approval.

Hope you will hear the good news soon.

quick question.. are you on the K3 route? did you ever file an I-129F as well? because according to your timeline you have not.

I honestly do not know the correct answer to what route it is. I was told K visas were no longer given that the process is CR for both spouse and fiance... I heard alot of confusing things... I do know I meticulously followed the instructions on the I-130 for and submitted all required documentation and evidence for proof of marriage and living together. I was living abroad with my husband for almost a year before we submitted the paperwork so we have plenty of legitimate evidence and I was able to check off everything that was required on the I-130 checklist. It made it all the way to Newark so if there was a documentation error I would have received an RFE long ago. Keeping my fingers crossed. Also, I did fax a letter to my senator's office, but at the time it was only pending 6 months. I will be sending another one. Thanks for the advice!

Hi Jennifer thank you for your prayers. This is so hard, I hate to see my husband struggle so bad. I can't stand to be without him its been hell having to be here and leaving him in Jordan where he barely makes any money to support himself.... I really need a miracle right now. :'( I wont give up or lose hope and youre right this is a test. I am thankful I got to spend a year and a half of my life with him overseas - but it only makes the separation harder to bear, me having to come back home like this. Best wishes to you and yours I hope my hubby gets approved with no AP as well.

some USCIS offices are open on saturday.

I'm a fan of infopass and stirring up sh|te with the I-130 Adjudication Unit Supervisor.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

My love arrived on thanksgiving and we are getting married this Friday - we are so happy and he is adjusting amazingly

I cannot explain the level of peace in my heart - I know how hard that separation is - even now for me just to be here at work

knowing he is home waiting for me I miss him tremendously.

And I understand about Amman - its miserable trying to support yourself there - Saif was always so short tempered, moody and depressed there

here is like a little boy - happy - calm and at peace...

Okay you so are on the CR1 path, not the k3. (you may want to change your timeline to reflect this... I notice your profile is correct. ;) ) I'm gonna ask for a mod to move your post so you can get more response. :)
