Oh, then you should file for AP too then. It is free and there is no reason not to file it. Then you can travel if you want to. You never know when an emergency might come up.

Have you found the appropriate VJ guide?

I was thinking to apply for AP but I get so confused with what i'm supposed to complete as I couldn't work out if I would be applying for Advance Parole or re-entry which I didn't know if i apply for one or the other or both.

I haven't found appropriate VJ guide no,I think that's why I get so confused with this,I hear one thing then read another and it contradicts itself so asking lot's of questions just to be sure from those who have been through the process or understand better than I do. :)

so, when you click GUIDES up at the top,

and are presented with a 'Table of Contents' ,

you are having a problem picking which Guide to use ?

OK !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

I had the same question. You don't need to file I-130 for K-1 Visa. This form is only for K-3 or CR visas. I-485 is for AOS for K-1. Definitely worth filing for AP and EAD. The guides help figure out the confusing language on the AP and EAD forms. Check out the K-1 AOS guide: http://www.visajourney.com/content/k1k3aos

If this is a snide, smarmy remark to try and make me feel like i'm stupid then shame on you, everyone is here for support, guidance and a helping hand. I'm like anyone else, trying to figure out what is required so I don't take the wrong route regarding my and my husband's visa process and if that makes me stupid for asking simple questions to make sure my packet is perfect then I will continue to do so...just worry about your own case and stop bitching about mine. Thanks

Nope, it was none of that.

OTOH, the landscape is different when using a handphone web-browser.

If you have some time today or tomorrow, come back on a PC, visit VJ again.

The landscape is different, and what you can see is different.

Handphone usage sucks for VJ for getting into the GUIDES section.

Happy to help! :)

When you're ready to submit, use the search box in the top right corner of VJ and search for "K-1 AOS Checklist" and check out the results. An example checklist, 2 years old but seems very similar to what I submitted. (Note: You don't need to submit a certified copy of the marriage license as long as you can make a color copy or b/w copy that's clear and legible) http://www.visajourney.com/forums/topic/337203-does-this-checklist-for-aos-from-k-1-look-good/

A cover letter is also a VERY good ideas. Plenty of examples of those on here too: http://www.visajourney.com/forums/topic/386377-aos-package-cover-letter-check-list/

I agree with the others. Suggest that you concurrently apply for the I-131(AP) and I-765 (EAD) with the rest of your AOS packet. It doesn't cost any more. There are numerous stores on the forum about folks that, due to the sometimes prolonged wait time for AOS completion, have to go back and file for AP and EAD later on. Emergency travel home to see a loved one is a common reason.

The EAD/AP forms can seem daunting, they were designed to be used for several immigration purposes. Follow the "Example Forms" accessible at the top of the forum page, for the thorough, quick and easy way to complete those applications.

Good luck.

Thank you both Daveykins and A&B. I have devised a cover letter and used the checklist to make sure I have everything in order to send. I am going to apply for the AP and i'm just going through it now. I have a question and the "intended travel date",I don't have an exact date,my husband and I plan to visit the U.K next June but we haven't a date,is it alright to simple put "June 2014"?

Thank you again for your help. :)

I also just read in the I-131 instructions that you need to provide evidence of your need for AP such as having a letter from your doctor to show your visit back is for Medical reasons...or if family related if there has been a death/accident,etc.

Nope, not for people applying based on being AOS applicants. AP is routinely approved for people with I-485 pending. You can put unknown for the dates and no explanation needed.

Agree with Harpa. As I previously mentioned, there are numerous forum postings about prolonged I-485 processing times, as a consequence, AP and EAD approval is routine. We included a copy of our version of the supplemental I-131 letter with our applications, refer to the previously mentioned Example Forms for details.
