HEEELLP! MARRIAGE VISA OR FIANCE VISA??

I am a US citizen who recently traveled to another country (turkey) to get married to my partner. He is syrian, residing/working in Saudi arabia. with the political problems hapening back in syria , we cannot marry there, and he could not bring me on his work visa to saudi arabia to marry, nor did we want to wait so long to get married int he states so we decided we will meet in turkey and marry. in turkey, he could not hand in some required paperwork for marriage, because some important documents were left in syria and there was no way for him to get them with the instability there. WE did a religious ceremony between a few friends and that was the end of that story because we tried all we could, and we finally accepted that we cannot marry on paper as long as syria is in the state it is in. I got pregnant in turkey, and could no longer stay there, it was too different for me and i just couldnt handle the change , so each went back home, I to the US, while he to Saudi Arabia and to his job. I wanted him to come to and be with me while giving birth to our baby, so we filed a tourist visa, and of course were denied, because they thought he will end up staying here. the officer had asked him, is your wife in the states? he replied yes, ALTHOUGH WE HAVE NO LEGAL DOCS. NOR ANY PROOF TO PROVIDE FOR A MARRIAGE VISA AND THEREFORE WENT WITH THE TOURIST VISA AND ACCEPTED THE FACT THAT WE WILL ONLY BE ABLE TO BE TOGETHER DURING THOSE FEW MONTHS. so anyways, point is, tourist visa was denied. i want to apply for something else now and try again. can i file for the marraige visa with no legal documents that we are married, or do we have to go through with the fiance visa????????????????????please help, i am so sad already because of what happened, i need some advice!

You will have to do the marriage visa because you are married. You may need to take another trip to get married on paper, if your religious marriage is not good enough. Check with the laws in Turkey to see if it would count. You might consider a lawyer because this will be complicated. Good luck.

says that religious marriages in Turkey have no legal authority. However, you might still be "too married" for a fiance visa. Given the circumstances, you may be able to get a fiance visa, but the argument about your eligibility should be done by a lawyer, I would think.

ya, sorry,

you aren't 'married enough' to file the I-130 to chase after a CR-1 visa

and

you are 'too married' to file the I-129F to chase after a K-1 visa.

How to fix? Did you have an Imam/Muallah sign off on any marriage document in Turkey? If yes, then it's possible for this person to get it registered in Turkey, however, he will need those 'other papers' you didn't have when you were in Turkey.

That's my take on it, anyway.

Hopefully you'll get some other input.

Oh my god, Im so happy you guys answered......i started giving up


ok first question, on t he paperwork, we did not state that we were married, just that we lived together for 3 and half months, and that i got pregnant and that we really want to be together for the birth of our son



second of all, i dont have a mullah, sheikh, priest, or any of the likes who can take care of the issue, i am not a turkish citizen nor is he, we dont even speak turkish.....it was so difficult for us there, we just went because no other country was easy for him to get into with his syrian passport/citizenship.....i overstayed my visa there trying to get married, so i dont want to go back, i have to pay a fee if i want to go back


so, im considering a single proxy marraige in kansas.......do you think itll make things more complex?

the thing about proxy marriages,

is that

to file the I-130, the marriage must be consummated after the proxy marriage occurs.

heres the the thing, i REALLY am not being able to stay without him for longer than a few months, i want to live with him while waiting for the visa, that is aside from my biggest fear of us being separated at different countries for one or two years and then him meeting his first son at two, which , just the thought of makes me wan to kill myself for getting tied up in this mess, and in saudi arabia, where he resides, he can only bring me.....if we are married.....obviously......so i thought ok file fiance visa, do proxy marraige, go live with him, (but that would make us officially married ) ..........so will that cancel the fiance visa????

You have some contradictory wishes, not unusual.

Do you know what Saudi needs to be considered married?

Saudi is not an ideal country to move to, bearable maybe if he is earning good money.

@ harpa Timsah, i need to clarify.....the religious ceremony, was done in saudi arabia, WITHOUT my presence, so turkey, doesnt have anything to do with it im guessing, no paper work, no documenting was done for it, it was me giving a friend "power of attorney",, two witnesses, the sheikh, and my fiance, they said a few vows holding hands in front of the sheikh....took pics , hugged, ate sweets, and that was it.....i wasnt there, and no one other than the 5 men was there.....THERE IS A VIDEO RECORDED OF THE VOW BEING TAKEN IN FRONT OF THE SHEIKH WHILE THEY WERE HOLDING HANDS

i hate the middle east, i cant bear living there, ill probably try to get back soon after i reach there as i have done every time i visited the middle east......saudi arabia, needs either me to take vows with him in court face to face, or my Islamicly accepted guardian to be present, my father or brother.....no way for my father will take part in this, and my brother would probably do it only after months or even a year, when he gets his break.
