we got the worst of news.... denied... on my visit last year we tried to be married there but i couldn't stay the whole 30 days required by that city, so we never got to finalize it, which is why we did the k-1 visa. well, the consulate decided that because we even tried then we are married in india. that is not indian law, sigh.... but so after everything we have been thru they now denied us and said we need to file the cr-1 visa instead. this would be wrong and illegal, as well as forcing us to go thru the whole process again, and pay the fees again, only to be rejected for not being legally married.... catch 22..... please pray for us.... and hoping you all have better luck.... :cry::cry::cry::cry::crying::crying::crying::crying::o:(

I'm so sorry for u guys!! I can't imagine how sad u r right now! But be strong and if u are going to start the cr1 petition, start as soon as u can, it takes a lil bit more time than k1. Don't give up

ty, i appreciate it so much... but no, we can't file a cr-1 as we never got to get married in india, we only started but i had to leave before we could finish, had to get back to work here. that was why we did the k-1, so we could be married, but the consulate didn't understand that, and if we file a cr-1 it would be denied....worse is that we would knowingly be committing fraud and could be held criminally liable if we did it.... our only chance is to get nvc to help, or uscis. i had given them all of the information and they knew that the marriage never was finalized in india... if they don't help then we are lost.... unable to get a k-1 or a cr-1..... :cry::cry::cry::crying::crying::crying::crying::shocked::shocked::shocked:

We all plan to get marry.... Or start prepare things for the wedding... Whats the problem if u are not married? I got my wedding dress when i was in the states. So what? They will deny my visa cause i got a wedding dress? Give us more info pls.

I'm so sorry to hear that. I'm sure if you get your Senate and congressman involved they should be able to help. I've heard of similar situations and one they enlisted help they were able to get approved. Did they ask if you attempted to marry, or was that information volunteered?

This is what i understood... In every country you have specific guidelines and procedures to get married,For example, in Venezuela, we need to get married first at a "Registro Civil" A.K.A(Also Known as Office of Vital Records then if we wanted to proceed with marrying at a Church then we also have alot of stuff to complete for that aswell such as getting baptist( This applies to those who havent, also have completed a confirmation and both of us would need to take a course that entitles "Premarital Counseling" etc..This would take months for us to actually complete it. but in your case you had a month but did not finish because you or your fiance had to get back to work. (Sorry I dont know whether your beneficiary or the Petitioner). This means that you actually did not get married, so you went ahead and applied for a K1 VISA instead......Is this right or am i wrong?? I am really sorry but yes you should contact USCIS or NVC to study your case further and to allow you to proceed with your K1 :(

thank you so much, and i can only hope and pray that they help... i'm the petitioner, visited my fiance in india last year. we tried to marry then, had an attorney friend who thought we might be able to get a waiver of the 30 day waiting period before they give the actual permission to marry. my attorney tried but couldn't get the waiver, and so we couldn't continue the process as i had to return to work, was not permitted to extend my vacation... i'm writing the nvc an email about it all, mumbai was wrong, and they are saying that uscis and nvc were wrong instead. only with the waiting period served while both of us are in residence in that city could we have been granted permission to finalize the marriage... mumbai has made so many missteps, but this one was the final blow, they returned his passport and are returning all of my paperwork to me and to the uscis.... praying no one else goes thru this, and that you all receive your visas soon... i think it is only mumbai that has such problems, i have read the reviews about them and mumbai seems to always have misunderstandings.... :cry::shocked::o:dead::cry::cry:

thank you so much, i appreciate it, and if nvc can't help i will have to go to them, but nvc could be quicker.... they didn't ask, i included it in our i129-f packet together with an explanation of all of it, so that there would be no questions later. or so i thought.... uscis and nvc saw this and approved us, as it was clear that we had not been able to complete all of the steps necessary to be married there in india.... but mumbai keeps misunderstanding, as they have misunderstood almost everything from the start....we have been absolutely honest and open about everything and still they have behaved so badly... they verbally attacked my fiance on almost every point in the interview, made him come back a 2nd day even, and then made him take the interview's continuation in english instead of the requested hindi... it has been one nightmare after another with them, but i think it may only be that one embassy.... :cry::cry::cry:

I didnt understand your situation. What does starting a marriage mean? Is this something peculiar to India?

we had wanted to get married when i visited him last fall, and tried to do it there but couldn't complete the process. it takes 30 days for a waiting period before you get permission to marry, if no one has objected in that time. my lawyer friend there had thought he might be able to get us a waiver of the waiting period and so we began the process, but the waiver didn't go thru and so we were unable to get the required license/permission to marry. that was why we decided on the k-1, we love each other and just want to be married, to live together as husband and wife, but.... mumbai...... :cry::cry::cry:

Im sooooo sooooo sorry for ur situation!!!! Woooow!!!! Maybe ask a laywer???? :( hire a laywer to fix everything right? Cause i think is a serius thing... U cant do even a comma as a mistake :( wish u will soon be with ur fiance.... And this nightmare will be over !!! From the bottom of my heart!!!
