Hello,

Just when I think I have a grasp on the AoS process, I read a post which makes me question things.

Current question is around I-94 expiration.

My fiancé arrives at POE on March 3rd. We will marry on March 10th and his K1 expires on March 16th. So unlike many we don't have 90 days to marry once at POE.

When does the 1-94 expire? Is it after a certain amount of days after arrival at POE? Does it expire when his K1 visa?

Thanks in advance!

You misunderstand. Once you enter the US the visa is used up and the expiration on the visa does not matter any more. There are not "many" people who get less than 90 days to marry. There are zero people in that situation. Everyone gets 90 days. Once you enter the US, the immigrant is issued a I-94 for 90 days, no matter when the visa expires.

His K1 expires on March 16th which means he has until then to use it to enter the US. When he enters on March 3rd the K1 will be considered used and no longer valid as it is a single entry visa. From the 3rd you guys will have 90 days to marry. The I-94 is valid for 90 days from the point of entry. Hope this helps clarify things for you. Congratulations in advance for your wedding.
