40 Quarters of work and the 864 form

According to the 864 instructions, one can skip the 864 (and provide the 864w instead) if the beneficiary has 40 (or more) quarters of work under the social security act. My husband (the beneficiary) has been living in America for many years (on various visas) and has been steadily employed here. He has, by my count, about 50 quarters of employment. He pays his taxes and has never been on any kind of government assistance.

Does this really mean that we do not need to provide an 864? It seems almost too good to be true. Why would the government be so generous?

This is important for us, because I (the sponsor) am currently unemployed, and we were worried that his application would be rejected for this reason.

You can go to ssa.gov and get your SS statement - it will tell you how many quarters of work you already have. Print that and enclose with the waiver.

You have to provide a different form instead; I believe it is I-864W.
