Summary: I logged into his Facebook account and saw conversations with his family members that he is only staying with me so he can file for his green card. He has been lying and sweet talking to me all this time so we don't get a divorce. He also talked to his father about how to get someone so he can cross the mexican border. He has been cheating on me with two other women and I have proof of all that. What should I do?

- I'm already heading to the Superior Court to get a restraining order.

- I'm planning on calling ICE and reporting him and his father too.

- What else can I do?

Does he have a green card yet?

If no, then cancel the petition, I-864, etc. He will not get a green card through you.

If yes, then divorce and go on with your life. There is nothing you can do aside from reporting him. Whether he gets to keep his green card will be up to USCIS. You will still be on the hook for the I-864.

I'm not sure what good a restraining order will do if he hasn't been physically or even emotionally aggressive.

Agree with the rest though, withdraw your I-864 by writing certified letters to wherever the case is pending and his green card will not be issued.

unsure where you are in the process, but

if the greencard has not arrrived yet,

withdraw I-864, the affadavit of support.

Without that form being in the casefile, any adjustment of status cannot occur.

USCIS is slow, laggard, and is best to make a shotgun effect to withdraw the I-864.

1. write the letter, sign it, make 4 sets with original signature.

2. send off via usps certified mail to:

a. address in the receipt notice, formletter I-797

b. local USCIS Office, attention I-130 Adjudication unit

c. local USCIS Office, attention Fraud Prevention Unit

d. address that sent the initial paperwork to.

Include a copy of the I-797 formletter, the receipt notice, with each postal piece. You don't have to claim anything or supply evidence with this postal mail - just a quick paragraph clearly stating that you are withdrawing your I-864 form, the Affadavit of Support and you are filing for divorce soon.

Alternatively, you can go in to the local USCIS office on an infopass appointment (see http://infopass.uscis.gov ) and hand the letter over to the clerk at the desk, asking for immediate supervisor review and getting it, before you leave.

calling ICE is useless, at the moment. If he already has his green card, consider to go in to the local USCIS office via infopass appointment, and talking with the FDNS officer (I think that's the right acronym), but you'll need to write much prior, letters of attestation that go over the evidence that you have. Even then, after dropping off all with the FDNS officer, it's still a crapshoot whether or not anything will occur quickly. Ultimately, it will affect his ability to file any removal of conditions casefile, later on, 2 years down the road.

If you are seeking a restraining order, get a 'removal from domicile' order as well (if your state does those).

If he has been aggressive already I would not even tell him what you know. Get the help you need through an attorney and protect yourself.

then no need to withdraw the I-864.

No paperwork filed then you need to file for divorce. What is the housing situation? Do you own or is he on the lease? You might have to move to another location when he is served with the divorce papers (if you are fearful) depending on the living situation. You might also be able to get a quick hearing for a court order regarding the living arrangements.

Without you filing paperwork he has no status once the I-94 expires.

One thing to watch out for is a staged abuse claim. The only way he can stay is if YOU are abusing him. Many will make a fake fight ( even injure themselves ) and then tell the police you are the aggressor Once he is aware you are on to him especially once separated NEVER meet him alone.

This will not be over quickly. You will not enjoy this.

You might want to talk to him also, well...ask the real status, and let him know you're aware of what's happening, watch how he react..he would be shamed of himself or else act like the angriest lion alive.

I see it the "other" way around, against you. He can claim that you access his "private" facebook unauthorized (and that is an illegal act). Since you have access to it, you also can falsify all those stories about "fake" relationship with you for immigration purpose.

Consult an experienced immigration attorney in regards to this matter ASAP. It's hard to conclusively prove that he's comitting fraudulent marriage for immigration purpose but very clear that you are illegally access other person's PRIVATE website (protected with password)
