Does anyone know if a marriage license is accepted if you havent your marriage certificate back in time to send before your time expires within the U.S 90 day period.

Marriage Certificate is specifically mentioned in the VJ AOS Guide and the I-485 instructions:

What 90 day expiration period are you speaking of?

The alien-fiance(e) has to get married to their USC-fiance(e) within 90 days of US arrival, refer to I-485 instructions for specific details.

Completed: K1/K2 (271 days) - AOS/EAD/AP (134 days) - ROC (279 days)

I'm sorry,I haven't been very clear. When I entered the U.S my 90 day stay began. I have until the 23rd December until it runs out. I recently got married to my U.S spouse and my marriage certificate is in processing and we may not have it returned to us by the 23rd December in order to send a copy as part of the AOS requirements. I have a license record with the witnesses and the pastor's signitures and details,I don't know if I can submit this instead of the marriage certificate if it doesn't arrive back in time before the 23rd December.

You don't need to file AOS within 90 days, that period of time is for getting married only. Just send paperwork when you get your marriage certificate. Licence may not be accepted as they specifically ask for certificate.

I thought in order to stay in the country you need to have sent off for your AOS before the date in your passport expires?

You cannot use a marriage license in lieu of a marriage cert. You can stay past the date of your I-94. Filing AOS sooner is best, but a few days is not a big deal. See what you can do to get the marriage cert back sooner. Good luck.

They only suggest you file AOS before 90 days because of the Advance Parole and EAD, after your i 94 expires, you cannot leave the country, work, get a SSN, or a license...you won't be forced out!

You can't do those things if your I-94 is expired and you have't received AP or EAD.

You can apply for a SS# as soon as you arrive. You need a valid I-94 to get a SS#. If it expires, you would not be eligible to get a SS#.

You need a SS# to get a drivers license.

You can not travel or work until you have received AP or EAD respectively...which requires you have filed for AOS.

You are not required to file for AOS within 90 days. You can wait to file but, as was said, you can't travel or work.

To make it extra complicated, in some states the endorsed marriage licence (stamped and signed by the county clerk or equivalent) automagically becomes the marriage certificate. Other states issue a marriage certificate which is separate from the marriage licence.
