I130 processing time

Am I imagining that I read somewhere that they said the standalone I130 processing time went from 11 months to 7 months or so (can't find the link or was I imagining). If that is so, then they should at very least be transferring cases from early may as that is 7 months. While I am not surprised that that is not happening, I am surprised by not seeing many more May filers putting in service request and complaining. I think I've learned over my time that USCIS is going to mess you by promising things. Looks like they sent out that stakeholder note acknowledging delays and the mumbo jumbo to keep people quiet. Nothing seems to be getting done to reduce times if almost all of April hasn't been approved already. They should have at the very least been transferring May plus applications if they want to get them approved in 8-9 months.

Guess not much changed...just a way to keep everyone quiet.

If I remember correctly, the processing time is 7.4 months. However all service centers are also posting that they are working on Feb 2013 petitions. Which means that they will not accept a service request from anyone that has filed after Feb. Based on USCIS, only people in Jan 2013 can file for a service request..

So it's then true that USCIS is feeding ####### to everyone lol and have really not done anything...Amazing how this agency works. Wish I could find the link that stated they should be approving in 7.4 months if anyone has that. I cant find it.

Thanks I found the processing time stating effective Sept 30.2013 as saying that NBC/National processing time is 7.4 months and yet when u go to individual, they say for processing Feb 2013. So I guess they want to look good by stating they are processing in 7.4 months on average yet in reality "don't bother me if you are not before Feb 2013". They sure fool people and get away with it too.

I suppose based on current trend, anyone post May can expect their approval in about 11 months as they haven't even transferred all April and yet have to approve them. They are also not proactively transferring post April cases except for expedites and I see some filers living abroad got transferred. Rest are not going anywhere.

My friends, don't rely on the ####### you see on the USCIS website. Government agencies aren't sincere. I'm not sure of what it will take for them to implement processes not-for-profit small organization with limited are able to do. Here's an instance - http://www.usatoday.com/story/news/nation/2013/02/27/veterans-medical-records-house/1952143/ idea9dv.gif

Let's hope we all wake up by 2 am and see a text message from USCIS indicating approval.

Due to the natural disaster in the Philippines, all files with a PH beneficiary have been expedited. It is only natural that things will slow down for the rest of us.

As for USCIS processing times, they made a mess of things and right now they are trying to rectify them. They are trying to process files by the 7.4 month mark, but right now they are still off.

The reason for the Feb 2013 date, is also understandable. For if everyone that is over the 7.4 month filed for a service request, they will spend more man hours trying to processes those service requests, taking away from actually processing and approving cases.

Filers that are being transfered right now, with the exception of PH expedites and DCF, are essentially getting a service request.

Do we wish that they worked faster? Yes.. Should they hire more people? of course.. but training someone takes time. That new recruits wont be our saving grace. If anything they could delay us even longer.

I just hope they keep doing what they are doing and try and get closer to the 7.4 month mark. Maybe by the end of December, we will see a better processing date of 7 months or 6.8 and a May 2013 processing date.

USCIS policy seems to be treat CR1 filers like mushrooms- keep us in the dark and feed us horse c**p!

A new letter about this is soon to be sent out to USCIS and politicians so if you aren't aware of it http://www.visajourney.com/forums/topic/468148-2nd-letter-to-house-jud-cmte-i-130-delays-by-uscis/page-2#entry6682399

Unfortunately with USCIS, there will always be one reason or another to slow down for one or other group. It's not something that will ever ever change because as you said, they don't have enough man power, plus they are not accountable or respond to anyone, including the government. Even when u file a request through ur local senator or rep, you don't get an answer. That being said, you can't leave them to their own devices because as they say the squeaky wheel gets the grease. They have never had their act together and will never and only way to get anything done is to try proactively. there will always be a reason when it comes to USCIS putting your case aside for something else. I can't have sympathy for USCIS that never plans ahead and even when faced with what they are doing wrong, will just pacify you with mumbo jumbo. It never changes. I am generally a very patient person but well you get marched over a lot if you just sit and wait and make excuses and try to understand where the other person (USCIS) is coming from. USCIS has a track record of always messing one group or another because they don't plan and don't care.

I am in for the letter campaign. You can be sure that if you just sit and wait for USCIS to get it's act together in it's own time, you will be waiting a long time. Anyone in May, June, July right now I believe is looking at about 10-11 months based on current situation.

All we can do is get them to be more honest about processing times and to admit they have messed up. Sadly for us filers waiting the damage was already done by letting I-130's stack up and processing DACA files instead. But there's nothing wrong with making a noise about what's happened, and hopefully USCIS will start to be more honest and up to date about processing times so at least some of us can start to plan for the future then. I really do hope that things at USCIS improve for future filers but I don't hold out any hope!

I never said I sympathise with USCIS. Nor did I ever say that I am pacified by their words.

What I did say was that it is understandable as to why they have stated a Feb 2013 processing date. I understand the reason behind their actions. I never stated that I agree with it.

What I wrote above were facts, and a statement of hope that USCIS keeps their word and works to achieve their promises.

When you call USCIS, tell them you want to speak to Tier-2 and then ask that person to file a service request, since they are saying that they are processing files from Feb 2013, you are eligible for service request and also ask tier-2 if you can expedite your case since it is outside their timeline.
