I recently got RFE.

1. It says I need to submit a complete Federal Income Tax Return submitted to the IRS from the petitioner/sponsor on Form I-864 for the most recent tax year.

I submitted 2011, 2010, 2009 tax returns of my husband. He did not file the return in 2012 because he made so little money from a contract position that H&R Block told him it wasn't worth filing at all.

2. It also says that the tax returns I filed do not meet or exceed 125% of the poverty guideline. (Which I checked btw, they all exceeded). And the current income listed on I-864 does not have evidence. But I DID file the copy of his employment letter. I wonder why they want this to be re-filed.

What do I need to do from here??

You need to include an explanation for why he did not file 2012 taxes. You will need to show exactly why, not that H&R block said not to (if he made just a little I would file anyway and likely get some money back).

Can the explanation letter be just a simple and not signed by any official such as IRS or notary??

Also, do I need to submit a new I-864? The letter didn't say anything about that though.

Yes. I attached W-2 (2009, 2010, 2011 and 2012) and payroll stubs of 3 months (unfortunately HR was only able to pull out 3 months, not 6 months)

I just sent mine with my husband's written letter with IRS article where it states amount requirement to file a tax return.
