Used to be a 3-yr ban, so I'd say they loosened up the rules as it's one year only (I know, one year too long, but still).

Do you have any other info about this? Since it's only based on his admission will they ask him to tell them the last time? I wonder how they keep people honest about this or do a standard year for anyone. Again tests were negative so it's only on his word...they have no evidence of it.

Nothing official yet. He is supposed to speak to the doctor tomorrow but I'm expecting they'll tell him to do the testing every 3 months for a year.

Just remember reading about it somewhere on here. I tend to read a lot of threads, threads linked in threads and so on, and I just have that idea that I read that somewhere. The topic of drug use comes up every now and then.

Regardless, it's a good thing for him to ask about. It seems odd to me that they have people whose test was positive and need that one year of testing to confirm they're clean, and treat them same way they treat someone whose test was negative and has already shown it's been a few months since they last used.

I mean, the whole thing is kind of subjective, isn't it? One thing is for people to admit they last smoked two months ago, what about those whose last one was 5 years ago? 10? 20?

Thanks all for the responses. This is such an upsetting process and I really appreciate any info we can receive on how to deal with this. Going to hire a lawyer to see what we can do.

Hiring a lawyer? IMHO that sounds like a waste of money to me. I would agree with others that you must just sit out the 1 year ban. And remind your fiance to just say no. Good luck and God Bless you both,

Aloha Ke Akua

This is horrible, I would say well over half of perfectly healthy law abiding people have tried some kind of drug and it was cruel for the doctor to do that to him, maybe he hates his job and just wants to play with peoples lives, was it the Asian doctor by any chance?

Is there a difference between a Asian doctor or Caucasian doctor? Are you implying racism here?

I am perfectly healthy law abiding people and I DO NOT do any KIND of drug.

Done with K1, AOS and ROC

Yes there is, stop trying to insinuate what's not there. It's just a descriptor.

A while ago, there was an allegedly insane Asian CO in Nigeria that was denying every sinlge one at her window.

Yes it was the Asian doctor! Totally understand that you're just asking if it's a doctor you're aware of...not a racist remark. Did you have a medical with him?

Haha no I wasn't being racist, you seem fun ...

I was simply asking because my Asian doctor at the medical was very unprofessional and kept prodding at flaws in my body which had no medical relevance, stretch marks and puppy fat aren't a public charge lol

Could you move to the UK for year? And then you could get married and apply for the CR1. Then at least you'd be together, and he'd have the green card on entry and not have to worry about AOSing

Sorry, but I have to disagree with you. You state, "Well over half of perfectly healthy law abiding people have tried some kind of drug." Where did you get those numbers? Perfectly healthy law abiding people, like my self have not, do not, and do not plan to ever use illegal drugs such as marijuana. Marijuana is illegal, plain and simple.

My goodness! it must be a cultural thing here, I should have put id guess that, I wasn't actually giving factual statistics obviously. In England at least I think it's the majority of adults that hav tried at least one drug

You must remember. You are wanting someone to be allowed to enter the USA. In the USA it is against Federal Law (which supercedes any State, County law or local ordinance) to possess or use marijuana. It is illegal, not cultural.

The point here is not that he had previously used marajuana it is that the doctor pressured him to admit it when it was irrelevant to his future actions in America , just because he might have smoked some pot at university by no means hel be shooting up in America . His lifestyle did not include drug use and did not appear to look like there would be any future drug use so why would the doctor knowingly focus on it

The horrible thing is I lived in California for 2 years and they were the biggest potheads I ever met, all holding their little medical marajuana cards

Just want to add. I can't stand drugs but appreciate that when you're young you can make stupid decisions and these shouldn't follow you

FIrst and foremost it is his medical examination. He is a customer paying the Doctor (yes I know the embassy considers themselves the customer). He should have been an active participant in the medical examination.

Secondly, he wasn't prepared. He should have researched to fidn out what happens during exams in London. I researched for my Wife ad nuseum so that she can know what to expect.

This is not meant to flog the OP and her SO but as a guide for others to involve themselves in this process actrively by doing research. This immigration thing is a big deal and needs to be taken as such.
