Hi good day to all, my fiance is planning to file for k1 visa but the thing is the last the we saw each other was in 2011 due to his complications with work, and we didnt even have copies of our hotel stays and other recipts back then but we do have a lot of pictures together with families and friends. weve been together for 5 years now. any suggestions on what things should we do? Thanks much appreciated

If you haven't met in the last 2 years, you're not eligible to file the I-129f. You'll have to meet again (make sure to document it well!) and then file your petition.

Your topic says you haven't met in 3 years, but you say you last saw each other in 2011 (2 years ago) - what dates specifically? If it was December 2011, you still have time (just).

Okay. So, that means you're not eligible to file any more. Better plan a vacation! Remember to keep copies of boarding passes, hotel receipts etc. this time around and then your filing will be more straight-forward.

Then i think we just have to get married here then. Is it possible to apply spousal visa ahead of time? So we can both go in US at the same time? Because hes planning to have a vacation next may by then we can get married.

No. You have to actually be married to apply for the spousal visa (CR-1 via the I-130 petition).

If you got married when you see each other next, then you can file the I-130 for CR-1. You'll not be able to file the I-129f for K1 anymore, just to be clear.

The I-129f for K1 is currently still processing more quickly than the I-130 for CR-1 (although that could change). The K1 route is taking 6 - 9 months, the CR-1 is taking 9 - 16 months, or there abouts.

If he can go there to marry you, then why not just have the trip, not marry, and use the evidence from that trip to file the I-129F?

He needs to go over there before Either visa is filed... Once you have met in person again, whenever that is, you can either file the for the K1 or if you get married in the visit, file the CR1. But nothing can be filed till you have another visit.

You need to meet in person somewhere....can be for only a few minutes between flights in some airport....but you need to meet in person.

Your petition will be denied if you don't.

You just have to find a way for both of you to meet each other or you will not be eligible to file the 1-129f and even if you decide to marry both of you have to be present for the ceremony. I don't understand how you two can go for that long without seeing each in real life and you have been in a relationship for 5 years.

Well, money for one thing can be a huge barrier. I couldn't meet my husband for the first 5 years of our relationship because we were kids in school :D

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

You MUST meet within 2 years...no exceptions. Answer: Meet each other and document evedence of a bona fide relationship. Do not waste your time and money applying at this point.
