Since my husband and I recently married and I don't have a SSN yet and we live with his mother, the only evidence we can give is from a third party affidavit (his mother).

I'm looking at this http://www.visajourney.com/wiki/index.php/Affidavit and I'm really confused. Who is the applicant, beneficiary and the petitioner? I'm the UK citizen who came here on a VWP and he is the US citizen.

11/08/2012 - Became a couple online smile.png

08/21/2013 - I flew over from England to Boston to meet him smile.pngwub.png

08/29/2013 - I was due to go back home but decided to stay a little longer

09/20/2013 - We decided to get married smile.pngheart.gif

10/22/2013 - We got married!!!

12/13/2013 - Day 0 - Sent off I-130 and I-485 and I-765 to Chicago

12/16/2013 - Day 3 - AOS Packet arrived in Chicago according to USPS

12/20/2013 - Day 7 - Received e-notification to say case has been accepted and processing at the USCIS National Benefits Center.

12/24/2013 - Day 11 - Received official Receipt Notice (Form I-797) in the mail.

12/31/2013 - Day 18 - Received letter for biometrics appointment on January 23rd.

01/13/2014 - Day 31 - Received RFE for form I-864

01/23/2014 - Day 41 - Biometrics done!

03/04/2014 - Day 81 - RFE response sent!

03/06/2014 - Day 83 - RFE response arrived there!

03/20/2014 - Day 97 - EAD card in production!

03/26/2014 - Day 103 - EAD card mailed out!

03/26/2014 - Day 103 - EAD card in USPS possession and given tracking number

03/26/2014 - Day 103 - Green card interview being scheduled! :D

03/30/2014 - Day 107 - USCIS mailed out our interview notice, scheduled for May 6th!

03/31/2014 - Day 108 - Received I-765 EAD work permit in the mail!

04/01/2014 - Day 109 - Received appointment for GC

05/06/2014 - Day 145 - GC interview approved!!!

I wouldn't use a template. For an affidavit, the more personal the better. The ML should write a letter with her full name and contact details, attesting to the validity of your relationship and marriage. She should explain how she met you, what she knows of your marriage, etc.

You are the applicant. Your spouse is the petitioner/sponsor. There is no real beneficiary for AOS (technically you are the beneficiary of his I-130 but these terms don't really matter).

as long as you dont say you came on the vwp with intent to marry as that is fraud and you will be deported if the interview goes that way my friend done the same and just got approves with thr skin of his teeth

but you can show bona fide if you know the guy and have been with him before if not good luck

So I've done the affidavit letter for mother-in-law to sign. Because I don't have SSN yet so we can't have a joint account and we live with his mother so we have no lease or anything like that, I decided to include photocopies of cards from people congratulating us on our wedding and also a copy of the hotel receipt from August (when we had our vacation before I decided to stay here and elope). We don't have receipts for rings because we haven't gotten rings yet as we eloped. Will this be enough, do you think?

Oh, it was her words, I just typed it. So I have:

  • Affidavit
  • Copy of a card my mom sent me after we married to congratulate us
  • Copy of a card a friend sent me after we married to congratulate us
  • Copy of hotel receipt from August that we both stayed in when we met in person for the first time
  • Copy of a birthday card I sent him in March when we were chatting online

I might include a few photos of us too. Hopefully that will be enough and I won't get an RFE.

Timeline

You can get a joint bank account without a SSN, or at least be added to the account your husband already has. You have to fill out a special form at the bank, but it's pretty simple. You should look into it.

You won't get a RFE for evidence of a bona fide marriage because you will be having a mandatory interview. They can assess your marriage then by asking you questions. Once you get your EAD you can also start to get joint stuff to bring to the interview.

It is possible to get on a bank account without a SSN, but it is hard to do and many banks don't know about it, and you'll have to argue, etc. Your evidence looks fine for newlyweds. We only sent 3 affidavits and our interview was just 2 minutes long.

Yeah, that's what they told me at first ... but we kinda dug around for information, and went back in and they said that yes, it is possible but the particular person we spoke to at first didn't know anything about this form. I've been trying to remember the name of it since I wrote that reply yesterday, but I can't figure it out ...
