You can't appeal such a ridiculous outcome, my understanding of a Fiancee Visa and I'm no expert, but dont you need to show proof of work history before Your even at the interview stage?

I hope if nothing else your able to get a co sponser, and move on with your happiness.

Hi my fiance had his interview this morning and. First off I have to say that I’m very disappointed because they gave him a paper saying I don’t qualify because I don’t make enough. I do make enough. He said you they only took the affidavit and my tax transcripts and did not take none of my financial documents or anything such as paystubs and job letters from my job which shows I gotten a raise and everything that shows that I make enough. Yes it does not state it on the tax transcripts because if I gotten a raise in 2013 it is not going to say I make that from both of my jobs. I have worked two jobs and worked very hard to meet the income guidelines just for them to say I don’t . I worked had just so I would meet the financial part of this and for them to say that I don’t qualify that is a big blow to the head when I know I make enough. And for the fact that they did not look at paystubs and asked us to bring these items. Is there something i can do. They said i need a sponsor but i don't have one. Can i marry him there then file for one him to come.

Okay let me ask this did your 2012 income meet the guidlines of your household? Or did you just get the 2 jobs this year?

Last year plays a big part in many of these embassies they don't just look at current. I don't know why people think current is all they want to see. They want to see job history.

Also people always advising "get a second job". The CO knows inn most cases you are doing this just to appease the Affidavit of support and they know you will quit soon as he/she is here (think like a CO not like you).

A I-134 is not legally binding and you are not entering any contracct with givernment (unlike the I-864 you will later file at your Adjustment of Status).

I would first email embassy with your whole I-134 package and ask for clarification why. In the meantime get a co-sponspor that meets the guidlines of their househod plus your finance'.

Sorry about this but just a delay bump in the road.

I totally agree with ktichuszim..

Some of the members on here is so rude....the fact of the matter is that none of us are immigration officers or immigration lawyers and we all give a little advice or make comments base on our experiences....even though there are guidelines most people experience is different....and the fact that you are making a comment base on your experience doesnt mean you are wrong....i was wondering why the site was dying slowly but i came to realize that people might browse the site but refuse to comment because they fear being attacked...no one on here is here to see anyone fail because on top of the long wait...we all know how time consuming, nerve wrecking and extremely expensive this process is...so even if you dont agree with someone elses comments...post your own...leave the person to determine what route they choose to take and stop being so rude to others...

Also, remember, if you made enough this year - you can file your 2013 tax returns in January. You don't have to wait until April 15th. You can do it anytime after December 31st. So, you could file that in January and then be able to show for real that you do make enough - on your own. And remember, January is in less than a month!

Being direct is not the same as being rude.....rude is the catchall name when people post something that someone does not want to hear. Meanwhile, others freely castigate the embassy or consuls, as if they know far more than the very people who have been trained and have the experience and knowledge to conduct their job/responsibilities far beyond the knowledge base of any single applicant.

Perhaps many would prefer to read something like..."oh, just call your congressman and set the embassy straight..." while failing to realize that no congressman can order the embassy to do anything. Congress is in the Legislative branch of our government while the State Dept is in the Executive branch,....and no one from one branch can tell somebody in another branch of our government what to do.

Voicing displeasure or disagreement won't bring about a solution, no matter who agrees or disagrees with your complaint. Better to respond to the request of the embassy rather than try to elicit some random reply from people who have no knowledge of the rules and regulations, but have only an opinion that is not likely to be based on their vast experience in the field of immigration law.

The interviewing officer likely has interviewed hundreds if not thousands of applicants, depending on their own time in the State Dept....that amount of first hand experience and exposure to our laws greatly exceeds by leaps and bounds opinions of others who have not sat behind the interviewing window.

I am sorry to hear this! I read the forums a lot and I have heard repeatedly that current income is just as important if not more important than past income. I have read reviews for my consulate (Tunisia) and there are other K1 filers that say current income is what really matters. Our interview is approaching very soon and I really hope current income has a bigger emphasis than past income. Anyone who has recently been through this, I would love to hear from you :)

I am sorry you felt my words were rude. But i can see what the issue is now after what you said just now of your job history. The 2nd job you haven't been there long enough. You have only been there 2 months. They want to see at least 6 months of pay-stubs.

Like I stated many here on VJ say get a 2nd job to make uo the difference but you have to be in the job abit to build up credibility. So it doesn't look like you are just working that 2nd and 3rd job just to appease them.

I realize you know why you are working the extra job and its not about a job. But the CO doesn't know you. As i was saying think like them what would they think a young mother bringing over her fiance with 2 jobs. You have to think like them to know what they want.

Since you have no co-sponsor you probably will have to do like the previous poster said and wait to file 2013 taxes next month. And this will give you some months to get more work in and show a working job history.
