HELP!!! I DONT KNOW WHAT TO DO ANYMORE! 5 MONTHS SINCE NOA2 AND NOTHING!!!!

What exactly do you think an attorney can do? Nothing is the answer. Most likely an attorney wouldn't even take a case that has already been filed anyway.

To the OP: The thing to do is to call your state senator and speak to their immigration liason,have them inquire on your behalf. When I was having trouble at the NVC that is what I did, and I had an answer and the solution to our problem the same day they inquired. Don't screw around with an attorney, it will be flushing money down the drain. Good luck and keep us updated.

Oh well that's no problem! Just because ya'll were a lucky one just don't mean that attorney's aren't good for everybody!

I can't say yet that it was "flushing" money but well that's ok! Hope for any other good ideas here from other couples.

Wow, That's horrible but typical of the USCIS. From my own experience calling the USCIS many times is most of the people just give you a standard answer out of a book. I would just keep calling & eventually you will get someone who has some knowledge & really cares. The last time I called they told me my case wouldn't be looked at for 2 months and then 2 weeks later I got a notice of approval. Very strange the way they handle each case but I feel your frustration.

I suggest that you pray first then get in touch with your Congress man. It works, it did for me. After almost 8 months I had it. I got in touch with the congressman in my area. After not even 2 weeks they responded. It was a positive one.

Next time you contact your congressman be very, very specific in "case file location" inquiry.

Telling them the whole story and relying on them to ask the right questions will not work.

You tell the congressman exactly what to ask USCIS / NVC.

Even though they are immigration liasons, many are not trained enough in depth to understand the process

and therefore can't articulate the pin pointed questions that need to be asked.

I would advice you to contact a different representative/senator who is more inclined to dig deeper

than the superficial previous inquiry. Again be as specific as grandma's cross stitch in the right questions

to ask. When rattling down your story to them keep it short and specific and list by bullets or

they will tune you out.

Sorry for this horrendous clusterfest they are putting you through. I have been hung up more than once by

USCIS also.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I agree that you need to know the right phrases. When calling DoS to inquire about paperwork/interview dates I would always get varying answers. I learned that "Chris" seemed to know what he was talking about and the "mmhmm" (patricia?) older woman did not (she mmhmms a lot). She'd just tell me when they sent out packet 3 which wasn't at all what I was asking. So some of them will do more work than others.

When I dealt with USCIS they did sent out a snail mail letter stating that they had checked into my case/etc.

I'd also suggest calling often to up your chances of getting someone who will truly help. At least DoS doesn't have the same horrible waiting time that USCIS does.

2/7/13 - NOA1

11/05/13 - CEAC Update. DoS says case is "eligible for interview" and we're waiting on next interview date.
11/08/13 - Another call to DoS (Chris is a nice guy!) and no interview scheduled yet.
11/12/13 - Another call to DoS and no interview scheduled yet.
11/13/13 - Email from Embassy to Steven informing him that his interview is TOMORROW.

It just seems like 90% of the people working there are not qualified at all, even the tier 2 officers just read answers out of a book… :(

Have you thought about filing a new one? The approval times right now are so quick and if they just don't want to admit that they lost your file it might be an option. I know our new I-130 was approved long before our first one that got bounced around quite a bit. You might even be able to request an expedite with the new I-129F on account of USCIS basically losing the first one.

Have you thought about filing a new one? The approval times right now are so quick and if they just don't want to admit that they lost your file it might be an option. I know our new I-130 was approved long before our first one that got bounced around quite a bit. You might even be able to request an expedite with the new I-129F on account of USCIS basically losing the first one.

We haven't really thought about that yet, but thank you for the idea. If things don't pick up within the next week or so, I think at this point that might be our best chance. So thank you very much!! :)

Ask for a Tier 2 Supervisor.

My fiance got to talk to a tier 2 supervisor once, on all other occasions the tier 2 officers refused to connect us… but at the one time we did talk to a supervisor we pretty much got the same answers as we have been getting from reps and tier 2… :( the supervisor send out an email on out behalf and said we would here something within 7 days, which once again was BS… I feel like almost nobody working there has any real knowledge about the whole visa process :(

my fiance received two letters in the mail today…they are both completely identical and dated the same! USCIS must be really messed up. One time we never received a letter that supposedly was send out, this time we get two…

anyway, the content of the letter(s) tells us pretty much nothing new, only that someone will look into it and that our case will be send to the NVC "as soon as possible"… thanks for our patients! and we all know what their definition of "as soon as possible is"! I will add the letter here, so maybe somebody as gotten something similar in the past?

the funny thing is, we got the letter TODAY, it is dated the beginning of november, a month ago! and refers to a call we made to USCIS on the 30th of october! maaaaan they are fast!!! *irony*

hope you are all doing well and that you have better luck than my fiance and I!
